Skilled worker visa extension Decision Pending

Post by vmathew24 » Thu Jun 30, 2022 8:03 am

Hi
My current skilled worker visa is going to be expired by 29/09/2022. I have already applied for extension and it is already crossed normal decision timing which is 8weeks. If I have to travel in case of emergency, is there any issue if I return back to UK before the current visa expires? ( without getting a decision on the application which is already made)

The earliest you can apply for extension is 3 months..

It seems you applied for extension too early, which is illegal.

Also, you can not travel outside of the UK until a decision been made on your visa application.

Two options available for you will be -

1. Wait till you get a decision on your application.
2. Withdraw your application and apply when you're back in the UK as you have nearly 3 more months validity on your visa.

It's not illegal but your application would have been admissible in normal circumstances. Since they are already running late and you are already within 3 month preapplication it would be admissible.

I am pregnant and wanted to travel to my home country for further treatment. This has been already informed in our cover letter but seem nobody care about it.

If it's getting late I am not allowed to travel after 32 weeks. Don't have any other options.

UK health care has one of the the best pre and post natal care. You really need to have strong reason that NHS can't provide so that the UK home office can allow your application to be maintained inspite of leaving CTA.

They do provide some leeway if there are mitigating circumstances.
