Including bonus to fulfil financial requirements

Post by meha » Mon Jul 04, 2022 7:31 pm

Dear respected members,

A friend of mine has made an application for ILR but her partner has not met the financial requirement.
Applicant's partner worked part-time due to covid and on the day of application had 1 month full-time.
The calculated income for 6 months was well below £9,300.

Now the UKVI have written back asking the applicant to submit documentation to prove the required level of income.
Two months have passed since the day of application and the applicant's partner has 3 months full-time but still falls short to satisfy the requirement.

The question is, can a bonus received recently be used to cover the missing amount in order to satisfy the financial requirement?
Is the six months period up to current date or up to the date of the application?

Below is the email received:
We are considering your application and need further information from you. Please provide the following within 10 working days of the date of this request:

We have noticed on your application you have stated you do not meet the financial requirement and you have not provided any financial evidence.

We are giving you the opportunity to provide evidence in order for you to meet the minimum income requirement.

Please provide these documents electronically in a PDF format to the following email address.

Any help is greatly appreciated.

Kind regards,

Meha

A bonus does count as income, see the guidance:
https://assets.publishing.service.gov.u ... rement.pdf

bonuses (which can include tips and gratuities paid via a tronc scheme
registered with HMRC) will be counted as income, where they have been
received in the relevant period(s) of employment or self-employment relied
upon in the application

Without knowing the details of your friend's application and assuming she doesn't have any income herself. if with the bonus her partner passes the required financial threshold one possibility might be to ask the HO to vary the submission date of the application so that the bonus can be taken into account.

Financial evidence in support of the application must be submitted.
