ILR eligibility

Hi,

I have completed 5 years with a combination of Work permit and Tier 1 (general).

WP - 9/2003 to 05/2008
Tier 1(general) 06/2008 to current

I have a gap of little over 6 months from jan 2006 to july 2006 when I was working for the same company at bangalore. I returned to UK with the same visa as it was still valid.

Apart from this none of the absences are long enough to disquilify me. most of them being for less than a month.

Can anyone please advice if this will cause any problem for my ILR application?

I got married in 2005 and my wife has had an additional break of 5 months after the delivery of our son. Will it really matter how long she was outside UK?

Were you getting paid in the UK with tax & NI deducted, whilst your stay outside UK?

I was not getting paid in UK for that period. Is this bad?

I head that if we include a letter from the employer that I was working for the same company for that period at a different location, the application would be considered. How true is it?

Since you were not getting paid in the UK, although you were working for the same employer, I am afraid your absence will be treated as a break in continuous residency.

What about those who were on deputtion abroad and salary paid in uk ni ,tax deducted

Provided you can get a letter from UK employer stating the same, I guess you should be fine.

[hi what about persnal holidays and you are still getting paid .
If these are within the limits set out for absences considered, you should be fine.

My holidays are 207 from which 30 days are paid (10 days once and 15 days once . so am i eligble
