Category for dependant visa extension, I have ILR?

Post by vic_msn » Sun Jul 03, 2022 12:41 pm

I have ILR granted in 2021 and my partner is on a Tier2 dependant visa which is expiring shortly.
My partners dependant visa was first granted in 2019 when I was on a Tier-2 visa.
Under which category should I apply for the extension for my partner's visa?
Can I apply for extension as dependant under the Skilled worker visa category?
When it asks for my GWF or UAN number, should I enter my ILR application details or my previous Tier2 details under which she was originally the dependant?

Yes but it is your partner who applies, not you. If the application is granted your partner will get a mandatory 3 year extension.

Your Tier 2 details should be entered.

Thanks for the clarification,
but when it asks for BRP number or UAN number, I can enter the BRP number of my ILR?
I also no longer work for the company which was sponsoring my Tier-2 visa,
but when they applied for the original dependant visa, they were okie support my partner with financial assistance (Yes in the application) for the first month, will this still be the case, should I get any letter from my previous employer. My partner is also working and can support herself and I can submit bank statements.

Financial requirement for a dependent partner or dependent child of a Skilled Worker
SW 33.1. If the applicant is applying for permission to stay and has been living in the UK with permission for 12 months or longer on the date of application, they will meet the financial requirement and do not need to show funds.

Thanks again, I have now paid for 2.5 years worth IHS charge as it asked for the expiration of my work/visa and I entered 31/12/2024 (as was in my ILR).
But my wife would herself become eligible for ILR after Jan 2024, which would only require 2 years worth of IHS payment, can I request for the visa extension to be granted only until say July 2024 (under 2 years IHS payment) and get a refund for £312 (0.5 year)?
There is no field to enter the number of years the extension is required for while completing the application,

Thanks

A PBS Dependent visa is granted for 3 years, as stated in the immigration rules. There is no discretion to grant a lesser time, so no, you cannot apply or pay for less time.

You also have to pay 3 years ihs and will likely be contacted to make a top up payment which could delay the process.

It has been more than 7 working days since the appointment(priority service) for my wife,
we have not yet received any email or letter. The date has gone past the current validity of the existing BRP, is there anything I can do to check the status with the home office?

Thanks

The date has gone past the current validity of the existing BRP,
as long as the application was submitted before the expiry of her permission that permission remains in force and she has not become an overstayer (section 3C)

No, just wait, others also report delays in the priority service.
