IHS charge for Spouse Visa Application - Missing my visa route and type

Post by Sal1994 » Wed Aug 03, 2022 3:30 pm

Hi, I am currently working on applying for a spouse visa on behalf of my wife to join me in the UK from Germany, she is a german citizen. We have completed the application form and when we are directed to the IHS page to pay, it shows that her visa route is "Settlement" and visa type is "wife". When i am filling in my details (person she is joining or remaining with in the UK), i am unable to find my current residency type in there. I am currently holding a Humanitarian Protection residency, however such option does not exist in the drop down menus. i would like help with 2 things:

1. Is "Settlement" the correct visa route for her? i assumed so since it was preselected for us?
2. What visa route option do i select since Humanitarian Protection isn't available on there?

Thanks

Look again, the relationship requirements in the immigration rules make your status eligible as her partner:

E-ECP.2.1. The applicant’s partner must be-
……………….
(c) in the UK with refugee leave or with humanitarian protection;

What is in the drop-down list?

Hi Mance, thanks for your response and thanks for confirming the first point for me.

re the second question, I was doing some research and found a Visa Type called "Post Flight - Non-Settled Person" which seems to be relevant. but see below the options. i didn't know how to post an image of the drop down list, so i wrote the "Visa Route" list:

Visa route
  • Dependant Child
    Dependant Partner
    Global Business Mobility
    Global Talent
    High Potential Individual
    Hong Kong British National Overseas
    Innovator
    International Sportsperson
    Intra-Company Route
    Non Points-Based Working visas
    Other
    PBS Tier 4 Student
    Settlement
    Skilled Worker
    Start-Up
    Student Study (non Points-Based System)
    Temporary Work
    Tier 1 (Entrepreneur) visa
    Tier 1 (Exceptional Talent) visa
Tier 1 (General) - dependants visa
    Tier 1 (Graduate Entrepreneur) visa
    Tier 1 (Investor) visa
Tier 1 (Post Study)- dependants visa
Tier 2 (General Shortage Occupation) visa
Tier 2 (General) visa Tier 2 (Intra-company Transfer) visa
Tier 2 (Minister of Religion) visa
    Tier 2 (Sportsperson) visa
    Tier 5 (Temporary Workers) visa
    Tier 5 (Youth Mobility) visa
    Youth Mobility Scheme
Most of them are obviously irrelevant for me, but when i click to see what "Visa Type" options there are for "Other" and "Settlement" i got the below:

Visa Route "Other" gave me the options:
  • Course F
    Parent of T4 Child
Visa Route "Settlement" gave me the options:
  • Child or Other Dependant of Settled Person
    Civil Partnership
Exercise the Right of Access to a Child
Family reunion - other dependant relative
Family reunion - under Part 11 Asylum, Immigration Rules
    Husband
Parent, Grandparent and Other Dependant Relative
    Post Flight - Non-Settled Person
    Unmarried Partner Wife
Do you think "Post Flight - Non-Settled Person" is the correct Visa Type for me?

You are on the wrong tack.

See:
https://www.gov.uk/settlement-refugee-o ... ly-reunion
APPLY OUTSIDE THE UK
Your partner or child must apply online for family reunion.
You can apply on behalf of your child but, in most cases, your partner must make their own application.
They’ll also have to complete application form VAF4A with Appendix 4.
They’ll need to have their fingerprints and photograph (known as ‘biometric information’) taken at a visa application centre as part of their application.

Fill in the online application, they'll probably also ask for VAF4 and Appendix 4 to be filled in:
https://visas-immigration.service.gov.uk/other-ooc
• Join or accompany a family member,
• In the UK with refugee leave or with humanitarian protection
• Select a country to provide your biometrics -Germany
• I have identified the location where I will provide my biometrics
• VISA TYPE Partner of someone in the UK with refugee leave or with humanitarian protection (family reunion) – visa fee free of charge
• APPLY NOW
• Register an email - Email address, password

I am afraid this route does not apply to me, as its only eligible to those who got married before they were granted HP. See eligibility written on the form here:
“You can apply on this form if you are the partner of someone in the UK who has been granted refugee leave or humanitarian protection. Your relationship must have existed before your partner left the country of their former habitual residence in order to seek asylum.”

I have had HP for 4 years now and i got married 2 months ago so this does apply to me and i have to apply through other routes. Any thoughts?

your wife can apply on the basis of Appendix FM:
https://www.gov.uk/uk-family-visa/partner-spouse

https://visas-immigration.service.gov.u ... 1632838838

Confirm your visa type – Appendix FM Partner
Select a country to provide your biometrics Germany
I have identified the location where I will provide my biometrics
Apply to enter the UK as a partner
Your partner must have have refugee status or humanitarian protection in the UK
Aspply now

We have filled in this form, my issue is currently at the IHS stage, which is separate to the visa application form and you get taken to it after completing the it before the final paying stage. What do we choose as my Visa Route and Visa Type when my wife is filling my details in the IHS form as i cant find a specific one for Humanitarian Protection

Cannot comment without seeing the form but your wife doesn’t need to pay the IHS or get an IHS reference number because she is your dependant and you are on humanitarian protection leave. See:
