Switching to skilled worker visa with expired visa in the UK

Hi

A friend currently in the UK had entrepreneur visa and his extension was refused. He appealed (administrative review) against it and has been waiting for decision for more than a year.

He wishes to switch to Skilled worker visa. Can he switch to SW visa as he is waiting for the outcome of his appeal? He is skilled and able to get sponsorship/employment.

Also, to add what if the Admin Review is refused, do you still get 14 days from AR refusal to apply another visa without being a overstayer or breaking your 5 years ILR count?
