Maternity Pay- is it Public funds

Hello All,

My wife is HSMP dependent has been asked by her employer to claim for maternity Allowance(MA) as she is NOT eligible for Statutory maternity pay(SMP).

My question is 'whether Maternity Allowance is considered Access to Public funds'.


I have made several calls to the UK BIA and even they do not have answer to this . One person who picked up the phone says that It is NOT considered and the other person says it is.

I even called the Immigration Enquiry Bureau on 0870 606 7766 but NO use

The following website says that Maternity Pay is not accessing Public funds http://www.fsa.gov.uk/financial_capabil ... et_6pp.pdf


But I want to be 100% sure.. can someone help?

The problem with such benefits is that you never know when they will take in or take out of public funds defination.
Obviously you have checked in lot depts. What matter is whther this benifit is consider as public fund when you apply for ILR. As you have to declare at that time that you did not used any public funds

If I am you, i will not take this benifit. But choice is yours

No need to worry, maternity allwoance is NOT treated as oublic funds. BIA's enquiry line need to get their act together.

I was a bit confused- since the following BIA websites list only statutory maternity pay as Not accessing Public funds- there is NO mention of Maternity Allowance anywhere.
