child benefit on work permit

Hello Members,
One of my friend is on hsmp and had got 2 kids, he was wondering if he can apply for child benefit.

No, if his leave to remain (visa) in his passport states 'No recourse to public funds'.

dnicky, it is not that simple. If only it were .....!

herts, your friend with the two children .... can you please post .... their nationality .... also the nationality of their spouse/partner?

Also, if either of them worked in a country, apart from that of their nationality, before coming to the UK, please supply details.

Citizenship of Parent & Child : Australian
Before Moving to UK : 3 years in Germany
Currently in UK on HSMP

Is it fine to claim child benefit for my 1.5 year son ?

meguesswho, the nationality of the other parent of the child? Are they in the UK as well?

meguesswho, that being the case, no sorry, they cannot claim Child Benefit, nor Tax Credits, while they both have the "No recourse to Public Funds" restriction on their visas.

It would have been a bit different if they came from NZ and not Australia! Why should that make any difference? There would still have been no ability to claim Tax Credits, but for Child Benefit one of the categories is:-
A national of, or a person who has come to live in the UK from, a country that has a reciprocal social security agreement with the UK which covers Child Benefit (regulation 2 (3) of the 2000 Regulations) - these countries are Barbados, Canada, Israel, Jersey and Guernsey, Mauritius, New Zealand and former Yugoslavia (i.e. applies to Croatia, Bosnia-Hercegovina, Serbia and Montenegro, and the former Yugoslav Republic of Macedonia);
