Irish citizenship by birth for kids of EU citizens.

Hi.

At the citizensinformation in the article about Irish citizenship by birth I see the following statement:
Parent from outside Ireland and UK
If you were born in Ireland on or after 1 January 2005 and neither of your parents were Irish or UK citizens, your entitlement to Irish citizenship by birth depends on your parents’ residence status and history.

One of your parents must have:

- Lived in Ireland or Northern Ireland for 3 out of the 4 years before you were born OR (please note that it is OR, not AND)
- Have the right to live in Ireland or Northern Ireland without any restriction on their period of residence
I wonder if kids of EU/EEA/Swiss citizens will obtains the Irish citizenship in such case because EU/EEA/Swiss citizens have a right to live in Ireland without any restriction on their period of residence?

Does anyone know cases when kids got Irish citizenship in such case? If yes, what status had the parent(s) (worked/studied in Ireland or just visited the country as a tourist and gave birth there) and so on.

As it said there, one of the parents must have (legally) lived in Ireland for 3 out of 4 years before the child was born. It doesn't matter if the parent is EU or non-EU.

If you are an EU national, in almost all cases, you should have been exercising EU Treaty Rights for 3 years - i.e. you are studying or working in Ireland, or you have shown proof that you have sufficient resources to live in Ireland without working.

Tourists are of course not included.

It is said OR (not AND) there. So 3 years OR the right to live in Ireland. If the people with the right to live in Ireland are not EU/EEA/Swiss nationals, then interesting who are meant there?

UK citizens have the right to move to Ireland and have the same right's as Irish from day one, they have the right to vote in Dail elections ect. EU citizens have to be exercising treaty rights e.g find a job within 3 months, show they can support and not able to claim welfare until a certain point. I imagine this difference has something to do with what your talking about.

EU citizens do NOT have automatic rights to live in Ireland ‘without any restriction on their period of residence’ (a.k.a ILR in the UK). Only UK and Irish citizens have that automatic right.

All other nationals must earn that right. For EU citizens, they must exercise their EU Treaty Rights for 5 years before they can obtain that right.
