Good character

Post by Sajid29 » Sun Nov 20, 2022 2:26 pm

Hello everyone, I want to apply for citizenship but I am not sure if my 10 year's is completed or not . I am going to write a paragraph from my SAR . I am going to summarise
I was student from 2009 to 2012 .

The Subject was interviewed under caution on 30/08/12 (asylum interview date ) . I travelled twice during my student visa . The subject fail to disclose to the immigration officer about his problem in Pakistan and therefore used deception to gain entry to the UK and stay in the UK .the Subject is there an illegal entrant verbel deception and committed a civil breach under section 26(1)(c) 1971 act and committed a criminal offence under section 24a(1)(a) 1971 act ,
A/CIO has authorised the service of IS151A, which was served in person on 30 08 2012 .

As there is some recent changes and I want to know if I can apply for naturalisation because I read on guidance that first day of deception is a day on which Home office find out ,so 30/08/2022 is the last date ?

Also my asylum was refused and I was going for a sign every week .and I get married in September 2013 with Eu national . So i just want to know if its better to wait untill September 2023 or i can apply now as my 10 years is completed ?

If you see between 30Aug2012 to September 2013 ,I should be considered illegal or over stayer as my asylum was refused , can you please guide me if I can apply now considering recent changes to good character.

Thanks

To align with changes to the qualifying period, where a person has committed immigration breaches relating to:

illegal entry
absconding
overstaying

may be disregarded when assessing good character during the 10-year period prior to the application, but only where all of the following factors apply:

the person is applying for naturalisation as a British citizen, or registration as a British citizen under s.4(2), 6(1) or 6(2) of the BNA 1981 after 28 June 2022

that person holds indefinite leave to enter or remain (ILE or ILR, also known as settlement) in the UK

no concerns (for example, regarding the person’s character) have arisen since the grant of settlement which might cast doubt on the decision.
