Temporary Admission ILR success

Hi
any body can help me ?

I came to uk in 2006 as student and then over stayer in 2010
applied Asylum in 12 may 2012
asylum appeal right finished in 2017
applied Further submission in 2017
after two years wait granted in April 2019 2.5 years Leave to remain
I was granted temporary Leave to remain since 12 May 2012 to April 2019
can I qualified for ILR for 10 years route on 12 May 2022 ?
ca I qualified Paragraph 276A(a)?
What does “lawful” mean?
To succeed under the 10 year rule, the 10 years of residence must be continuous and lawful. “Lawful residence” is defined at paragraph 276A(b) as:

“lawful residence” means residence which is continuous residence pursuant to:

(i) existing leave to enter or remain; or

(ii) temporary admission within section 11 of the [Immigration Act 1971] (as previously in force), or immigration bail within section 11 of the 1971 Act, where leave to enter or remain is subsequently granted; or

(iii) an exemption from immigration control, including where an exemption ceases to apply if it is immediately followed by a grant of leave to enter or remain.


So living in the UK with leave to enter or remain is lawful for the purposes of a long residence application, as is temporary admission or bail (e.g. asylum seekers) or exemption from control (e.g. diplomats) if that status is immediately followed by leave.

Yes you can apply in 2022 assuming you applied for a new visa before April 2019 and got an extension.

Hi Zumba

I was granted leave to remain in April 2019 for 2.5 years after asylum further submission and my current visa expired on 02/10/2021 and I already applied for further Leave to remain so can I qualify under 10 years long resident for ILR in 12th May 2022?

Yes. Temporary admission counts as lawful residence so you had lawful residence since 2012

asylum appeal right finished in 2017
applied Further submission in 2017
after two years wait Leave to remain granted in April 2019 for 2.5 years

Extended leave to remain till valid 16 Sep 2024
so my 10 years lawful residence completed on 12th of May 2022, I was granted Temporary admission on 12th of May 2012 and it was varied to SOS Immigration Bail on 20th Feb 2018, Leave remain granted on 12th April 2019 and further extended till 16 Sep 2024.

Set LR applied 12 Sept 2022
Biometric done- 07 Oct 2022

ILR granted 6th Dec 2022 today
