90 days

Post by shohjura » Sun Oct 02, 2022 5:52 pm

Hey guys
I have had indefinite leave to remain since January 2021 (on the basis of 10 yrs), i want to apply for citizenship in the next few months. I am now away on work trip which will last for 105 days. Gov.uk says if i am away from uk for more than 90 days i will be ineligible to apply for citizenship. If i am away for 105 days does that mean i need to wait for 1 more year before i can apply for citizenship? Also, i haven’t been away for more than 450 days for last 10 years even this 105 days included

Thanks!

There's no need to wait a whole year until you can apply with 90 days absence ... you just wait wait until your absences are down to about 90 days, remember it's counting 12 months back from the application date. You will have seen in the guidance that discretion may be applied to absences up to 100 days, and in some circumstances above that. If you don't want to wait to reduce down to 90 days then you'll need to provide an explanation for the excess.

The guidance states on page 12:

Absences from the UK during the last 12 months of your qualifying period will be
considered in the following way:
Quote
" 6(1) and 6(2) applications:
Normal permitted absences in final 12 months of your qualifying period 90 days
Total number of absences normally disregarded 100 days "

So you should be ok, suggest you include a note just explaining the excess absences.
