Switch to 5 year family route

Post by iz1 » Thu Dec 15, 2022 10:53 pm

Hello,
My friend just got approved for another 2.5 year family route visa. The issue is that he had requested to switch but it was granted on the 10 year route.
Is there any way he could request for it to be looked into apart from reapplying please?

Did he meet all the requirements to switch to a 5 year route? What is the basis of his flr do application?

Yes, the English test was done and provided. The wages was also provided with the employer confirmation.

The earlier question is unanswered: what was the basis for previous FLR application

Was your friend told the application was granted under D-LTRPT.1.2.
?

If so, they should state why R-LTRPT.1.1.(c) wasn't met.

The decision doesn't say anything as such, which is why I'm asking. Because I would have thought it would say why the switch wasn't possible.

If it was possible to post the full details of the decision leaving out personal details it could help clarify on what basis they reached their decision and granted the stay, and if necessary, request a reconsideration.

It appears only part of the decision letter was shared but it seems from what was shared they deemed the applicant did not meet the requirements and granted the leave with reference to GEN.3.2.(3) as mentioned in D-LTRPT.1.2. because of their child.

If it's not stated in the bit of the decision not shared and/or the applicant believes they meet the requirements, they should request a reconsideration (as previously advised) and ask why the leave was not granted under D-LTRPT.1.1. (which is the 5-year route).

I only cut off the part where personal details are. The bottom part talks about no recourse to public funds.
Thanks for your help, he will be sending the reconsideration request.

Thanks for the update, and it's good they drew attention to their error.

1. Reply to the 'FRHxx email that sent the decision letter?
2. Wrote a separate email to the 'FRHxx email address the sent the decision letter?
3. Sent a hardcopy prnted letter by post to the address given in the decision letter?

Your response will be most appreciated

Hi,
A letter was sent by registered post to the address on the initial decision letter.
I would suggest photocopying the proof you have also.although they still asked for it by email.

Good luck

Many thanks for your prompt response - very helpful.

I also recieved similar vague decision letter for my 2nd extension on 5 year route and have sent Reconsideration via email, but will now send same via post tomorrow.

Not sure how you concluded what aspect of R-LTRPT.1.1.(a), (b) and (c) their decision was based on as cannot figure out mine? Do you suggest I send along all my evidence or base iot on my sensse check on what might have gone wrong.

Just baffling.

Many thanks
