ILR to Citizenship--Need Help

Post by mandy1285 » Thu Jan 12, 2023 7:38 pm

Hi Guys,

I need to apply for my Wife and Kids citizenship Application . We are on ILR since June 2018 , though we were eligible earlier we have not applied for British Citizenship. I want to know the process of applying for Citizenship for below:

1. Wife
2. Kid1 Age 6 Yrs
3. Kid 2 Age 10

I am not willing to apply for citizenship for myself at this point of time.. Will it be any issue if I apply for Citizenship later?

Also I have few other queries..

1. My Wife has cleared the English language requirements when she got ILR in June 2018 . Will she need to clear the test again?

I read it at link british-citizenship/faqs-english-langua ... 98118.html that she don’t need to do it again as she is under exempt categories

Which are the Exempt categories?:

You don’t need to prove your knowledge of English if you:
a). met this requirement, on or after 28th October 2013, in order to obtain settlement (ILR or PR)
Can anybody share the official uk govt link for this pls ?

2. My Wife has cleared the Life in the UK Test and I believe she don’t need to clear the test now as per below?

https://www.gov.uk/life-in-the-uk-test
When you do not need to take the test
You do not need to take the test if you:
• are under 18
• are 65 or over
• have passed it before - for example, if you’re applying to become a citizen and already passed it as part of your settlement application

Also on the When to apply page https://www.gov.uk/apply-citizenship-in ... -to-remain I can see that
When to apply
You must have been physically present in the UK exactly 5 years before the Home Office receives your application.Your application may be rejected if you were not in the UK exactly 5 years before the Home Office received it. This depends on the reason why you were not in the UK. The Home Office will consider if there are special circumstances, for example:you were not able to live in the UK at the start of the 5 year period because of health reasons or travel restrictionsyou were told to leave the UK during the 5 years but this decision was later overturned

Can somebody please explain me what is this about?

Thanks in advance… I believe 1st I need to start with the naturalization process and then I need to apply for passport?

As she's done it for ILR - no.

Applying for citizenship
You can use a B1 level qualification that’s run out if you’re applying for citizenship and it was accepted when you settled in the UK.

Yes, if it's passed once, it's done.

That's what it says on the tin.

If you are applying under section 6(1), you must have been in the UK exactly 5 years before your application was received. For example, if your application is received on 05/01/2022 you should have been physically present in the UK on 06/01/2017.

Yes - naturalization is what makes person a British citizen, while British passport can only be given to British citizens (and other British nationality types, but it's not relevant here).

Children born in the UK have a right to be registered as Brits if any of their parents gets settled here. ILR not required for them. Which would have been different if they were born outside the UK.
