Query on ILR form submission

Post by baljitsingh197701 » Thu Feb 16, 2023 10:27 pm

Hi There,

I have to apply ILR based on 10-year route,

My First visa was issued on 13/05/2010 and I first arrived in the UK on 23/05/2010.
Visa Tier 2 (ICT) Established staff: Valid from 13/05/2010 to 17/06/2011.
T2 ICT) Long Term Leave to remain: Valid from 11/07/2011 to 18/06/2013.
T2 ICT) Long Term Leave to remain: Valid from 27/06/2013 to 31/05/2015.
T2 ICT) Long Term Leave to remain: Valid from 12/06/2015 to 14/06/2017.
T2 ICT) Long Term Leave to remain: Valid from 18/07/2017 to 14/06/2019.
T2 ICT) Long Term Leave to remain: Valid from 29/06/2019 to 05/06/2022. (Note: This was automatically cancelled when my T2 General came on 14/11/2020).
T2 General) Leave to remain: Valid from 14/11/2020 to 19/12/2023.

I Left the UK on 4th December 2011 and came back again which is Second Entry to the UK on 6th May 2013. First exit (i.e., 4th Dec 2011) to UK and second entry (6th May 2013) to UK is having the same visa or same visa category and during my time in India I have worked for the same employer and client. So, in a nutshell my visa category isn't changed. Then I changed to Tier2 General Visa and this 6th My 2023 I am completing my 10 years continuously without any gap (though I have gone for holidays but those are around 150 days in overall 10 years).

As per rules I can apply for 28 days prior i.e., on 8th April. 2023. Considering 8th April is holiday i can submit my application on 11th April 2023.

My questions are below if you could answer that would be good.

1) So, I need to submit my form from https://visas-immigration.service.gov.u ... 1651410136 on 11th April 2023 or I can submit this form any time before 11th April 2023 and only go for appointment UKVCAS appointment after 11th April?

2) I would like to go for priority service (5 days one - https://www.gov.uk/faster-decision-visa-settlement), so my BRP will arrive after 5 days, or will it take time after decision?

1. You can do either of these
2. Priority service is simply the visa processing service that gets you an expedited decision. It has NOTHING to do with your appointment or the speed in which your BRP arrives.

The 5 day option is not available for ILR based on long residence, however the next working day option to receive a decision is available which costs 800 pounds extra.

Thanks for your response, so just to be clear or check my correct understanding it's UKVCAS appointment that matter for 28 days before not the submitting of form?

The date of application is the date you submit and pay online. It is not the biometric appointment date.

Alright so in that case I should only submit the form on 11th April and then book UKVCAS appointment?

Yes apply April 11th and have biometrics after that. Guess that's straight to the point for you yeah.

Can I apply for 5 days service (£500), or 10-year route is not allowed to apply for 5-day decision?

5 day priority is not available for long residence applications.

Thanks, also document only i need to provide this or 10 year payslip for working to prove i lived here?

Documents you must provide You’ll need to provide:

a current passport or other valid travel ID
your biometric residence permit if you have one
all the passports you’ve held during your time in the UK
You’ll need to provide a certified translation of any documents that are not in English or Welsh.

There is nothing 'usual' about it, have patience to receive it, check timeline threads.

If using 10yr route it is ILR LR with LR meaning Long Residence.

If you have any document that can serve such purpose do provide, If none you won't be penalised.

Hi,

in SET(LR) there is a question "When did you first enter the UK?" should I put the date as 4th May 2013 (this is second time i came to UK on same visa which was issued to me on 2010) or should i put the date when i first came to UK i.e., 23 May 2010?

Note: As mentioned in first post i came to UK in 2010 and went back in 2012 and again came back in 2013 on same visa.

Mention the date that will correspond with the one to which this application for ILR is based on.

Hi,

I am trying to submit the SET (LR) form from https://visas-immigration.service.gov.uk/ site and I am getting normal fee (£2404), but I would like to go with super priority so I should get £3204 (normal fee £2404+£800). So question is should I pay £800 (super priority service) into visas-immigration.service.gov.uk or to UKVCAS?

"You are paying
2404.00 GBP - Mr XXXXXXXX application for Set (LR)"

If the service is available, you will have the option on the payment page. If you pay for standard service, you cannot upgrade to super priority later.

Availability is based on ukvi's capacity. Note also that super priority is not a guaranteed service either.

Members report getting the option around midnight sometimes.

Thanks.

I was referring solicitor weblink removed by moderator website where it says it should be from UKVCAS.

Now I am clear it has to be from UKVI not from UKVCAS.

Also based on your experience ( I am not going to quote you here but this is just for my information only), Super priority service is available for Set (LR) at midnight?
