ILR application...

My friend's current leave to remain is expiring in Nov 2009. By then he'll be completing 4yrs and 10 months.

This strange situation is because of the WP + HSMP . My question here is :


Can he apply for ILR at the end of current leave to remain or shud he for another extension?

If he goes for another extension when can he apply for ILR?

As has been mentioned umpteen number of times in various posts on this forum, one can apply for ILR only 28 days in advance of the completion of 5 years of his/her legal stay (for WP/HSMP category) in the UK.

Anyone falling short of this mark has to apply for an extension of his/her leave and then apply once he/she satisfies the above criteria (in conjunction with other eligibility criterias).
