Applied and paid for 2 years visitor visa and approved only for 6 months

Post by dradilmahmood » Sat Apr 01, 2023 3:46 pm

Dear forum members

Quick question!

My parents inlaw applied for 2 year standard family visitor visa from France this year (Non EU National) but instead of approving the visa for 2 years UKBA only approved it for 6 months.

They applied for 6 months visitor visa multiple times in the past and were approved for them. This is first time inlaws applied for 2 year visa.

Does anyone have any idea how to appeal to or is it possible to ask for the review as inlaws paid 2 year fee?

Best wishes
Adil

You cannot appeal a visitor visa. UKVI website also clearly states a long term visa application could result in a 6 month visa issuance. There is no guarantee a longer term visitor will be successful if applied for.

https://www.gov.uk/standard-visitor/app ... sitor-visa
Long-term Standard Visitor visas
You can choose to apply for a long-term Standard Visitor visa if you visit the UK regularly. This visa lasts 2, 5 or 10 years. You can stay for a maximum of 6 months on each visit.

If you’re under 18 years old when you apply, your long-term Standard Visitor visa will only be valid for up to 6 months after you turn 18. You cannot get a refund on the fee.

You may be given a shorter visa than requested if UK Visas and Immigration (UKVI) believe you cannot meet the eligibility requirements for the duration of the visa you applied for.

You will not get a refund of the application fee if you get a shorter visa or if your application is refused
.

Your visa may be cancelled if your travel history shows you are repeatedly living in the UK for extended periods.

Thank you very much CR001

In that case they should always apply for 6 months rather than long term visa because it is waste of money isnt it?

It really depends on their personal circumstances, ties to country of residence or home country, where they are usually resident as you state they applied in France, how long they plan to visit and how long they have visited in the past vs how long they have stated they will visit in each application (for example, if they stated they will visit for 2 weeks but then stayed for 5 months, it generally could count against them).

They have a permanent residence in France and are retired.

I think this was 6 or 7th attempt at visa. Rejected once in between.

In the application they state that they want to visit for 2-3 weeks and never stayed more than 4 weeks. On couple of occasions they visited twice in 6 months but only for 2-4 weeks.

Thanks CR001.

There were instances where visa granted were shorter than requested and when brought to attention of HO, they requested passport back and gave the full duration vignette that was requested by applicants. Still looking for it.

An update that UKBA have apologised and said that visa application centre will contact us to submit the passports for new vignettes.
