Family Visa - Less than 2.5 Years

Hi All,

I hold ILR valid until 31-12-2024. My partners visa is expiring in July. She will be eligible for 10 Years Long Residence ILR by Feb-2024. I am looking for cheapest option for her visa extension.

1) If I apply for Family Visa, will the expiry date be 31-12-2024?
2) Can I apply Family Visa for valid until Feb-2024?

Your ILR is valid for as long as you are resident in the UK and do not have an absence from the UK of more than two years.

Your BRP, and everybody's BRP, will expire on 31-12-2024, as the Home Office transitions to a digital only status, for all people holding leave to remain (whether limited or indefinite).

Your spouse's visa extension will be issued for the appropriate length of time relevant to her application. But, if she is issued a BRP, that, like all other BRPs, will be limited to the same date as you, even though her leave to remain could be valid for a longer time.

Is there a possibility to apply Family Visa for only required period, instead of 2.5 years?

Your ILR does not have an end date, it is indefinite. BRP validity date is just information about how long the card is valid, not the status (in your case, as you hold ILR). Visa will be valid for 30 months (2.5 years).

However, note that your spouse would have the same BRP validity "end" date as yours. Reason is that all BRP's are expiring at the end of 2024. But status validity would go beyond that (2.5 years).

Thanks. So as I understand, minimum 2.5 years of IHS charge has to be paid for Family Visa.
