When to transfer/extend Dependant's Visa

Post by fullmoenty » Sat May 06, 2023 8:39 am

I am currently on a SWV and have recently changed employers. I need some input on when to switch/extend my partner's Dependant visa. Some details below. Thank you in advance.

Main Applicant:

- Tier-2 General Application Decision (was not in the UK at this point): 27 February 2019
- First arrived in UK with Employer X: 6 April 2019
- Visa extended with Employer X: February 2022
- Extended visa validity: 5 May 2025
- Eligibility for ILR: 1 February 2024
- Visa transferred to employer Y valid from: 5 May 2023
- Visa transferred to employer Y valid to: 6 August 2024

Dependant Applicant (Partner):
- Visa Application Decision (was not in the UK at this point): 6 June 2022
- First arrived in the UK: 9 July 2022

Based on the information provided, here are my questions:

1. When do I switch/transfer/extend my partners dependant visa?
2. Is the main applicant's eligibility date for ILR correct?
3. Is the dependant's eligibility date for ILR correct?

Apologies for that. The Dependant visa expires on 31 December 2024.

That is the brp expiry date, all brps expire on that date. What was the duration of her visa granted and expiry date stayed in her approval letter?

Apply for dependent visa shortly before their visa expires. If you have ILR at that point, it will be a 3 year extension.

I have checked the approval letter, BRP and UKVI online, everywhere it states 31 December 2024. At the time she applied for my dependant, my visa was valid until 5 May 2025. Thank you for your reply. Can you validate from when I become eligible for ILR? Even if I combine the days between getting a decision and my first travel to UK, I won't be outside of UK for more than 180 days combined for 5 years, let alone one.

Odd. I think they should have granted partner’s leave in line with SW 36.1.(a).

See also Period between the issue of entry clearance and entering the UK

I think partner may extend when or after you apply for ILR, before expiry of leave.
