Which ILR category to choose SET(O) or SET(M)

Post by warhead » Sat May 27, 2023 12:12 pm

Hello Everyone,

Apologies, I am pretty sure this questions which I am asking must have been answered many times on this forum but unfortunately I was not able to find a post which answers my questions.

My wife who has now completed 5 years in UK and now want to apply for ILR but I am not sure which category to select. Below is our situation.

I am a british citizen via tier-2 5 year route and my wife's current visa(dependent) was granted when I was on tier 2 and she was/is my dependent. We have a son who is also british citizen.

in such case which ILR category we should fill her application? ILR SET(O) or ILR SET(M)?

If she has held a PBS dependent visa for 5 years, it is form SET O only that she can use.

Yes, if you cancel/withdraw before the biometric appointment.

Refunds can take a while and if you apply on the correct form, you will have to pay again.
