Query related to Surrender of an Indian Passport & Applying OCI

Post by kashish » Thu Jun 01, 2023 7:52 am

Hello everyone,

I would appreciate your suggestions. I have recently received my British passport, but I am still waiting for my original documents such as my Indian passport and marriage certificate from the HM Passport Office.

Before my travel on July 21st to India, where I plan to visit my family for approximately 40 days, I need to surrender my Indian passport and apply for OCI (Overseas Citizenship of India).

I have a couple of questions regarding the process. Should I surrender my Indian passport first, wait for the surrender certificate, and then proceed with the OCI application? Alternatively, can I surrender my Indian passport and apply for OCI on the same day?

Furthermore, considering the time constraints, I am uncertain if I will receive my documents and OCI in time. Do I need to obtain an e-Visa for a 40-day visit to India?

Thank you,

Yes, you need to first surrender your passport, get the certificate and then use it to apply for OCI. the process is needlessly convoluted.

But the evisa approval takes only 24 hours in case you have to travel before that.

the turn around time to get an OCI before your travel is too short, you are probably better off applying for an evisa OR you could travel on the indian passport, come back and start the process of the OCI.

you could travel on the indian passport
Technically, OP is not allowed to do that.
https://www.hcilondon.gov.in/page/surre ... -passport/
There is a grace period of three months after acquisition of foreign nationality (to be counted from the date of registration / Naturalisation Certificate and not from the date of foreign passport) for using Indian passport for travel. But the grace period is not applicable once the British/Foreign Passport is acquired, he/she should travel only on the British/Foreign passport once the same is obtained even if he/she is within the grace period of three months.
