Child born in UK-ILR

Post by ifylolly » Sun Jun 11, 2023 7:03 pm

Hello, I'll appreciate a response to this query. I had my second child in the UK in 2018. I travelled to my home country with him for a visit in 2021. I'm about to apply for ILR, do I need to apply for him as he already has a BRP and is registered as my dependent?.
Thanks

If you mean "do I need to apply to him so he can get ILR or if he's going to get it automatically" - yes, you need to apply for him, it doesn't happen on its own.
But you can register your child (so he becomes a British citizen) when you have ILR, even if he didn't hold ILR before, via MN1.

What's the status of second parent?

I mean does he need the ILR before registration (MN1). Both parents applying for ILR at same time

UK born children don't need it.

Children born in the UK are entitled to be registered as British after one parent settles without a need for ILR
