Naturalisation Eligibility

Post by monza » Wed Jun 21, 2023 11:47 am

Hi My wife received ILR in March, she was on my dependent visa ( for last five year) as settled/British citizen husband. Is she eligible to apply for Naturalisation without waiting for 1 year?

Yes, since you're British now (subject to other requirements, of course).

Thanks Meself, what is the other requirement? As far as i know is 1. Life in the UK, Reference (2), 3. English language. Is anything I am missing here?

Absence/residency requirements (being present 3 years ago in the UK/not being out of the country too long). It's listed here - https://www.gov.uk/apply-citizenship-spouse

Thanks, She meet the criteria regarding the absents which is less then 270 or 450.
However she was out of UK during maternity 17 September 2018 to 9 March 2019.
And she is planning to apply naturalisation in September after her trip to India, so does she have be in the UK physically on the first day of 3 or 5 years exactly form the date of her application? Also can she submits online application while outside UK and when return take appointment for biometric?

"Proof of living in the UK for Mrs xxxx for 5 years if applying in your own right or 3 years if applying as the spouse of a British Citizen"
Is it a common online application for 3 or 5 year route? I can not see anywhere they asked specifically which route you are applying.
What document i have to supply proof of living in the UK? Is passport enough or I add more document such as bank statement, payslips?

There’s only one Form AN to use. No option to select which route. You just submit what is required for 3 or 5 years. As you’re under UK ILR passport covering the period is sufficient.

Yes, it's a statutory requirement. Also can she submits online application while outside UK and when return take appointment for biometric? Not recommended as the absences have to be declared, expectation is that applicant submits whilst in the UK. Best to wait until return to the UK.

Thanks for your response, just to clarify eligibility of my wife application based on 3 years spouse of a British Citizen route.
Husbands received ILR on 09/2017 and citizenship on 01/2019, then wife was on spouse visa form 11/2017 and form last 7 months (01/2023) on ILR.
Is it ok to apply based on 3 years spouse of a British Citizen route?? So, I can list the absence based on last 3 years not 5 years.
I am trying to avoid 5 years route as she was away for 6 months from present date backwards 5 years.

Yes you can go ahead with 3 years.
Make sure she was in the Uk on the first day of the 3 year period, working back from the application date.

Thanks a lot for clarification.

Last question, does date of application is count as online application submission date or the tired party (Sopra Steria Application) appointment date?
