Extending Spouse visa

Post by Mallu_Desi » Mon Jun 05, 2023 1:42 am

Hello everyone,

I am a UK citizen (through naturalisation) and my wife is an Indian national. We have a one-year-old daughter together. My wife came to the UK on spouse visa on 03 Feb 2021. Her BRP card shows her visa expires on 22 Oct 2023. I have a few questions regarding her visa renewal. I would be grateful if you can help me with these.

1. How early we can apply for her visa renewal?
2. Is there any harm/ good applying early?
3. Does it affect her future ILR/ Citizenship application?
4. We submitted UK NARIC English Language Proficiency Statement (CEFR level C1) issued on 24 July 2020 when we applied for her visa. This document is almost three-year-old now. Is this document still valid?
5. I see some people refer here as FLR (M) and FLR (FP). Is the spouse visa renewal coming under FLR (M)? What is the difference between these two?

To help with my queries I am including following information:

Visa start date on vignette: 22/01/2021
Type: D - Partner standard
Date of arrival (first time) in the United Kingdom: 03/02/2021
Date of expiry date on BRP card: 22/10/2023

1. How early we can apply for her visa renewal? 28days before completing 30months in UK from initial entry date I.e. from 03 Aug 2023.

2. Is there any harm/ good applying early? If too early she will have shortfall in completing 5years towards ILR SET (M) and may therefore require extension again for the little time with the attendant fees etc.

3. Does it affect her future ILR/ Citizenship application? See response to Q. 2

4. We submitted UK NARIC English Language Proficiency Statement (CEFR level C1) issued on 24 July 2020 when we applied for her visa. This document is almost three-year-old now. Is this document still valid? Can be reused as successfully used for previous application and if provider is still on HO's approved list of test providers.

5. I see some people refer here as FLR (M) and FLR (FP). Is the spouse visa renewal coming under FLR (M)? What is the difference between these two? Yours is Further Leave to Remain (Marriage) FLR(M)

I am slightly confused with your response. I was referring to NARIC Certificate, not the IELTS exam that we have to take for UK Visa.

Yes the new is there however when it will take effect/be implemented is unknown.
Do note that in recent time you just wake up and read on gov.uk that such and such policy is changed and effective immediately.

I submitted the hosing report and title deeds as part of my initial application. Can I still use the same housing report and title deed as part of the new application. It is obviously over two and half years old.

Not required for spouse visa extension.
Your evidence of cohabitation/correspondence tenancy agreement is what's needed.

We are living with parents. I am going to get a letter from my father who is the owner of the house. The house is mortgaged. Do I have to submit mortgage statement from mortgage lender?

What did you do to meet accommodation requirements for initial spouse visa application?

I submitted following documents as part of initial spouse visa:

•NOC letter from dad
•Dad’s passport
•Council tax bill (address to dad)
•Electricity bills (address to dad)
•My proof of address (mobile phone bills)
•Title deed (under dad's name. This dated around 2.5 years ago)
•Mortgage statement (address to dad)
•Mortgage redemption statement (address to dad)
•Survey report (This dated around 2.5 years ago). we did a small renovation in Spam and built an extra toilet recently.

As mentioned earlier we are living with parents. My dad is the owner of the house and the house is mortgaged.

Use similar documents as above and recently dated ones.
Survey report not required.

Doesn't cost much and you can get recently dated one.

If you use a foreign degree, you need the ECCTIS evaluation etc.

If she is using the IELTS English test, you do not need the degree and should tick NO to the degree question.

We are planning to apply by using foreign degree.

Is ECCTIS same as NARIC?
