Eligibilty criteria for children with ILE.

Post by dko » Thu Aug 10, 2023 7:40 pm

Hello good people,

A friend of mine would like to register her children born abroad as British citizens. They have lived here coming to 2 years next month. Ages 13,14 and 17 soon to be 18. She is now British live here with her now English husband (their step-dad). Question is;

a) is there a time limit for when the kids will be eligible to register as British Citizens? She has got conflicting information some saying 2 years and another 3 years.

b) does she need the consent of their dad (doesn't live in the UK) to register as British
Citizens?

Will appreciate any information you can provide her. Thanks

a) Section 3(1) requires children to be under 18. There are also other expectations, including children aged 13 or over to complete at least 2 years’ UK residence, etc.

b) Yes, unless perhaps if she has sole responsibility.
