Query about proof of residency starting year - citizenship

Post by hanamichi5 » Tue Sep 05, 2023 2:59 pm

Hi I am planning to apply for the citizenship in December and I am wondering should I count for the proof of residency,

1st year: 2023
2nd year: 2022
3rd year: 2021
4th year: 2020
5th year: 2019

Is it correct? or should I count 2022 as my first year?

kind regards,

Hana

How to count years for citizenship - stamp 4 EUFAM and IRP renewal

Post by hanamichi5 » Tue Sep 05, 2023 3:07 pm

Hi I have a question, two actually

I received my first letter for EU Treaty rights on 22nd October 2018 for a temporary Stamp 4 while I was waiting for the final decision. I received that temporary stamp on my passport on December 10th December 2018

I received my decision letter on 16th march 2019, saying that my application was approved and I would receive my Stamp 4 EUFam.

Now, which date should I use for the calculation of the 5 years residency to apply for the citizenship?

22nd October 2018
10th December 2018
or
16th march 2019?

Also, my IRP expires on 16th march 2024, can I renew it normally through INIS or should I apply for a permanent card?

cheers,

Hana

2023 is your last year, so it has to be continuous and right before the application.
I assume you arrived in late 2018 at least to qualify?

UPD - topics merged, please don't create different topics for the same query (your naturalization).

Count from December 10th, 2018; hope you didn't have absences above 42 days each year, otherwise you would need to add them to your reckonable residence.
You would need to apply for permanent residence (EU3) for renewal - if refused, you can go through EU1 again.

Thanks meself,

I arrived in 2014, but received my first stamp 4 on 10th December 2018 (temporary), and didn't have any absences.

I suppose applying for the EU3 wouldn't affect the citizenship application, am I right?

Thanks for the help

EU3 (treaty rights) and naturalization are separate processes indeed.

May I ask when is the official starting time for the new absence 70 days?

I would expect it to start when the bill with the changes has gone through all the processes and became enforced - according to the tweet below, it was two months ago.

I'm not sure if it will or will not apply retroactively, so IMO better be safe beforehand and assume previous time periods to be 42 absence days.
