ILR - Wife & Child

Post by talreh20 » Tue Sep 05, 2023 5:09 pm

Hi All

My Immigration History:
ILR 10 years route from June 2019 to August 23
Approved Naturalisation Sep 23 and due to attend ceremony end of Sep.

Wife and daughter on FLR(M) and completing 5 years next year Oct 24.

So when we are applying for ILR for my wife and child(age 8 years), do I need to upload my ILR which will be invalid? or do I need to upload my Naturalisation certificate/British Passport? Would it cause any trouble for my wife and daughter if I upload my British passport instead of ILR as they got their FLR(M) on the basis of my ILR?

Second: My other two kids (6 & 4) were both born in the UK and I registered them as British Citizens and they received their certificates because I didn't have ILR status on their births. So my question is, as they received their certificates/British citizenship on the basis of my ILR, do I need to keep my BRP ILR card as the Home office said to return the card or I may face a fine of £1,000?

Many thanks in advance.

FLR(M) is a category given to spouse of settled or British Citizens. Settled in your case is your ILR. So their category hasn't changed. You could even argue that it's been solidified. Upload your BP.

Second: My other two kids (6 & 4) were both born in the UK and I registered them as British Citizens and they received their certificates because I didn't have ILR status on their births. Advisable to keep it. This is the evidence you kids might need in future to prove their entitlement to BC, if the case ever arises.

Many thanks in advance.

Hi All,

I am in the process of finding temporary work for two/three years overseas (probably Gulf). I have received my naturalisation certificate. The idea is that my family will remain in the UK and I'll relocate temporarily and return in two/to three years' time. Just to confirm, we are not divorcing or separating or any such thing. But to only earn enough tax-free income and save up to be able to afford a house in the UK. As my wife and child's ILR is due next month and one of the conditions to get that is to prove we have lived together for 5 years, so would my temporary relocation cause any issues for my wife and child getting ILR since we haven't lived together for one year?

One year isn't much. I presume you would make frequent trips to the UK during this period. The HO can interpret in whatever way, hard to tell.

Sorry. I wanted to write Next year.
That's the plan to make a visit every 3 months for around 10 days to see the family.

Thanks Ticktack for your valuable input as always.
