Hi admin, Appreciate your hard work and help to many people.

Kindly suggest me on the below queries please. thanks in advance and have a wonderful day ahead

Myself - ICT established visa -Date of first entry - Aug 2010 - got Ilr in dec 2020 - british passport - 2021

Mywife and Elder child (born in 2007 in india) - PBS dependent visa - date of 1st entry - aug2010 - switched to spouse visa in july 2020 - current visa expires in 2023 November -
gaps of both - July 2013 to sep 2014 - travelled to india due to health complications , pregnancy - at the time of july 2013 went to india when my wife and elder child has valid visa -
but PBS dependant visa expires in India in march 2014 - applied in july 2014 - received in aug 2014 and both travelled to uk - 1st sep 2014. so officiall start date after break is sep 2014 - no gaps after this.
current spoue dependant visa expries in 2023 novmebr for both my elder kid and wife

2nd kid - pbs dependent visa - date of 1st entry - born in india - March 2014 - switched to dependent visa in July 2020 - current visa expires in 2023 November - overall stay in UK - 9 years 4 months

3rd kid - born in uk , he got British passport - so no issues

Queries :

1. Can i just apply Spouse visa extension for my wife in nov 2023, leaving kids not to apply. once mother gets , kids can get British passport directly i believe.
my only concern is 2 children would be overstaying if i dont apply for them in nov 2023. Is it allowed for kids to overstay until mother gets ILR in few months of time where father is British passport.?

2. Apply family discretion application in nov 23 and if decision doesn't arrive by aug 204, can we vary the application to long residence ILR?
3. is any new rules where i can apply directly passport or home office naturalization application to kids (9 years 4 months) on the basis father is british passport and mother on the path to ILR . (as we know both kids born outside uk).
4. My wife has valid reason for outside Uk in July 2013 to sep 2014 due to health complications where doctors in India suggested not to travel . is exceptional circumstances discretion rules will apply for her long residence 10 years ILR. also husband is British passport and younger child is British passport and all are staying since long time.

Kids need to apply to keep regularising their stay alongside their mother. This means extensions, ILR and registering to be British. No shortcuts my friend.

Your British citizenship has no weight on your spouse or your children born outside the UK before you became settled in the UK. Don't think it opens any special doors. It doesn't.

That is incorrect. The kids are not eligible for either a British passport or British citizenship automatically.

The only time a person can acquire British citizenship automatically is if certain specific conditions are met at birth. If the person is not a British citizen at birth, the only way to acquire British citizenship is by being registered or naturalised as a British citizen.

No.

If you plan to register your children as British citizens, they are expected to have either
(a) lived in the UK for 10 years lawfully (on any combination of visas, does not require ILR), or,
(b) at least one parent has or is applying for British citizenship, and both the other parent and the child have ILR.

You would need to give compelling compassionate reasons why a child living illegally in the UK should be registered as a British citizen if the conditions above are not met. And saving money is not a compelling compassionate reason.

Keep in mind that discretion being applied for ILR will not mean that the discretion may apply automatically to naturalisation. The rules and requirements for naturalisation are separate, under different laws and rules and just because one gets ILR with discretion does not mean that discretion will automatically be applied to the naturalisation application.

2 small queries please

1. Iam a british passport. My family on appendix fm spouse/partner leave to remain visa since May 21. They are due for extension on Nov 19th 2023. I heard if we apply before 4th october'23we can save the fees. How soon can i put application for them from today

2. Can anyone share the appendix FM spouse/partner leave to remain Home office application link so that i would apply and fill the right application to HO ?

It is a 2.5 year visa not a 3 year visa.

Visa fee already quoted above - £1048 per applicant.

IHS is currently £624 PER year = £1560 per applicant

IHS fees due to increase in the Autumn, no date set as yet.

I have spoken to solicitor about my wife application spouse visa and 2 children dependant visa and he advised from 4 th October new increase in ihs

Kindly confirm is it correct

Applications submit before or on 3rd October 2023

Healthcare Surcharge (Adult) £1,560 x 1 = £1,560
Healthcare Surcharge (child) £1,175 x2 = £2,350
Visa fees £1048 x 3 = £3,144
Total Government fees £7,054
Application submit on or after 4th October 23

Healthcare Surcharge (Adult) £2,587.50 x 1 = £2,587.50
Healthcare Surcharge (child) £1,940 x 2 = £3,880
Visa Fees £1,048 x 3 = £3,144
Total Government fees £9,611.50

Difference in costs £2,557.

You had the link from CR001 earlier, did you read through? That's from the government make your comparison with it.

Actually I don't want to end up paying more IHSafter October 4th'23 as my solicitor says they r increasing from October 4th'23. Not sure how he got info.

If govt is not increasing the Ihs fee in October 4'23 I can apply spouse visa for my family in Nov 15'23 as the visa expires in Nov 20th '23.

It's a big money difference 2500.
So kindly suggest me.

The increases have been published on the official government website, per the link that ha been quoted above. Your solicitor is correct. The increases are subject to parliamentary approval which is normally a given, there is unlikely a debate about it.

Similar to what was used for initial spouse visa minus TB certificate and proof of ongoing relationship.
Add evidence of cohabitation covering last 2years solely 12pcs or both named 6pcs from minimum 3 sources evenly spread 3-4months.
Add English language test certificate at Level A2 but best if you get B1.

As you fill the form you will see what's required though list may not be exhaustive.

last year randomly - 2021 - 3 statements - jan, june, dec
2020 - 3 statments - feb, july, nov,
Total - 12

similary electricty - last 6 months + 2021 3 statments randoly + 2020 randomly 3 statments - 12
counicl tax - current year statemnt - 1
total 13

totally 25 documents (council, electracy, water)

for the list of documents, i have small doubt

as am sponsoring(my annual salary 66000 gbp)
, am uploading 1) my p60 2) 6 months payslips 3) employee letter confirming salary

for financial support , iam sponsoring so that the above documents am uploading, however

my wife is earning 1000 per month

do i need to provide my wife bank statemtns aswell,?
do i need to povide her payslips aswell?

Your P60 is not required neither is there a need for tour wife's bank statements to be provided.
As you meet and want to use your income for financial requirements, stick to yours only.
