New COS and 3 months notice Perios

Hi,

I'm currently in ICT Visa and I got an offer in UK with Sponsorship. My current COS expires on 09th Dec 2023 and Visa expires on 23rd Dec. I have to serve my 90 days notice period and my last date is on 03rd Jan 2024.

But in the new COS, my COS start date was mentioned as 22nd Dec 2023 and I have applied for the Visa with that ( Priority Service ) . I already conveyed to my new company that I will not be join as mentioned in COS and I can be able to join after 03rd Jan, They are fine with that and they said within 28 days there are no issue.

Will there any issue with the gap of 12 days in my COS ? Also am I okay to work ( to serve notice period ) after COS expires (i.e. 09th Dec ) with my current company ? Please clarify my queries. Thanks

If the work end date in the CoS your current sponsor assigned to you is 9 Dec they are not allowed to employ you beyond that date. You'll need to come to some agreement with them about not being able to work out your notice period

Whether below is not applicable in my case ?

8. A worker who is sponsored on a Worker route or a Global Business Mobility route other than Service Supplier, and is making a ‘change of employment’ application, is permitted to work out a contractual notice period for their existing employer, provided they were lawfully working for that employer on the date of application.

I don't believe this applies in your case because your sponsorship will end on 9 Dec assuming that was the work end date stated in your CoS. You can start working for your new sponsor from the start date in the new CoS, 22 Dec

Thanks for the response.

I have got the decision today and but it in the letter it was mentioned that I can stay till 04th Jan 2016.

But my cos end date is 21st Dec 2026. I suspect instead of 04th Jan 2027, it was provided wrongly to me.

What I have to do now ? I think it will take another 7 to 10 days for my BRP . I called customer care and asked me to raise administrative review . But they said it will take 6 months .

2016 is probably a typo. Wait for the BRP

Thanks ..today I received my BRP and it has 31/12/2024. We all know that’s the end date for BRP date .. I think only option for me to raise an Administrative review .

No BRPs are being issued with an end date beyond 31/12/2024 because the system is changing to fully digital then
