Entry clearance decision letter is confusing

Post by pizzapizza » Thu Sep 21, 2023 11:21 am

Hi All,
My visa-
Tier2 (general) Migrant
Visa issued for 5 years - Dec 2018 - Jan 2024
Am I eligible for ILR in Dec 2023?

There is a line in Appendix of the Entry Clearance Decision letter which is confusing -

------
UK Visas and Immigration is an operational command of the Home Office

(Non-Standard 1)-because you satisfy the requirements of paragraph GEN.3.1. of
Appendix FM; or ⚫ (Non-Standard 2) - because you satisfy the requirements of paragraph GEN.3.2. of
Appendix FM; it means that you are currently on a 10 year route to settlement. If you continue to meet the

requirements and make the appropriate applications for further leave to remain, you are likely to be
eligible to apply for settlement in 10 years. If you are later able to meet the requirements and make an appropriate application, it is open to you to switch to start a 5 year route; however, time spent on the 10 year route will not be counted towards it

------
I satisfy all requirements for 5 year ILR route, can i still apply after 5 year ? Or do I have to wait for 10 years before applying for ILR?

This is for people who are granted leave under Appendix FM of the rules (the 10-year family visa route). This has no relevance to the people who were issued a Tie 2 General visa (i.e. the skilled worker visa). Can you post the text of the whole decision letter ?

Post by pizzapizza » Thu Oct 26, 2023 6:00 pm

Hi,

Ill keep it very simple, I am on Skilled Worker Visa.
Visa Vignette has dates : 25th Dec 2018 - 24th Jan 2019 (1 month initial visa sticker)
Decision Letter has dates : 25th Dec 2018 - 15th Jan 2024
BRP has dates : 9th Jan 2019 - 15th Jan 2024 (Also 9th Jan 2019 is the date I entered the UK)

When can I apply my ILR application :
1. 25th Dec 2023 -28 Days
2. 9th Jan 2024 -28 Days

Thanks
