Eligibility for ILR

Post by hag9 » Sun Nov 12, 2023 10:28 am

Background:
Main applicant: now british citizen (after 2 years ILR + 3 years tier 2 and global talent visas)
Wife: in UK since Jan 2020 as dependent on tier 2 and global talent visas

Question: will the wife become eligible for ILR after completing 5 years in the UK? Or is she already eligible for ILR since her husband is a citizen and she has been already living in the UK for more than 3 years?

Also, when will she be eligible for citizenship? After 1 year on ILR? or as soon as she has ILR?

Thank you!!

Yes.
Or is she already eligible for ILR since her husband is a citizen and she has been already living in the UK for more than 3 years?
No she is not eligible for ILR, there is no 3 year route for dependents. She needs 5 years on PBS Dependent visa to qualify for ILR. There is no shortcut route and your UK status as British is irrelevant.
Also, when will she be eligible for citizenship? After 1 year on ILR? or as soon as she has ILR?
As soon as she gets ILR and assuming she meets all the requirements for British Citizenship. Please note that citizenship questions should be asked in the British Citizenship sub forum, link below, as these questions are irrelevant to the ILR sub forum.
