ILR 5 years route

Hello, I have a question and would appreciate assistance from anyone with a similar experience. I'm preparing to apply for indefinite leave to remain in December 2023, and I'm facing challenges meeting the financial requirement. I've been with my current employer for over 6 years on a permanent contract, and I receive weekly payments for a 40-hour workweek. This is my payslip for the last 26 Week

I had zero earnings in week 22/09 due to unpaid leave, and for week 15/09, my earnings were only £265.43, a combination of working and unpaid leave. The figures mentioned are net income, not gross. Over the last 26 weeks, my total net income was £9,097.63 and gross income was 11.112.46

My concern is regarding the week 22/09 where I had £0.00 earnings due to unpaid leave, as reflected in the payslip. Despite my overall net income being £9,097.63 and gross income 11.112.46 for the 26-week period, I am unsure if this specific week could impact meeting the financial requirement.

As per Appendix FM 1.7 if you are with a current employer for more than 6 months and are receiving non salaried income, then the calculation will be as follows:

"To calculate this annualised average for non-salaried employment in Category A the
following calculation should be used:
(Total gross income from employment held throughout the 6-month period, divided
by 6) multiplied by 12 = Income from non-salaried employment that can be counted
towards the financial requirement."

So judging by the figures you have provided your gross annual salary will be £11,112/ 6 x 12 = £22,224. Hence this would meet the financial requirement if you require to meet £18,600. The fact that you received no income for week 15/09 is irrelevant.

If I may ask my query is on this matter as well.

My wife entered UK 29-12-2018 so I will be applying on 02/12/2023 using priority service to hopefully receive approval within 5 working days.

So my question is does the Biometric needs to be timed such that a decision is taken on or after 29/12/2023. Or will it still be ok to book biometrics around 5/12/2023 and get a decision before 29/12/2023?

1. Please do not tag your questions onto other membera topics. It is considered rude and unfair to other members.

2. Keep all your ilr questions in your own topic, this one.

3. There is no 5 day priority service for spouse visa holders. You have only standard service or Super Priority options.

4. It doesnt matter when biontrics appointment is. The key date is the online application date, which can be within 28 days before reaching 5 years. Ukvi do know their own rules and concessions.

ILR can be granted within 28 days of completing the 5 years.
The date of the decision is all that matters: How to apply early and benefit from the date of the ILR decision ?
