Hi guys just wanted to know of there new salary threshold changes would affect people already om the current skilled worker visa

When will the new immigration rules ne in effect and will this only affect new applicants or existing visa holder eg change in salary threshold and graudate visa

I am guessing you are referring to the detail in the below link.

Note that this is still a proposal for consideration and NOT a 'new rule' at present.

Any rule changes will affect all visa holders, so if you plan on extending or applying for ILR, you need to meet the salary requirements at the time you apply.

My current swv is valid till 2026 and if I'm below the threshold will I need to reapply?

IF a new threshold is brought in, then for ILR you would usually have to meet the new threshold.

Until the government changes or implements the rules, we are just guessing here as this is currently ONLY a proposal!

It is pointless stressing over something that MIGHT not even happen.

Oh ok but I can still continue to stay in my current swv till expiry on the old income thresholds?

Correct, any new requirement will have to be complied with at the stage of visa extension and or switching of visa/employer.

Op can continue to stay on current SWV however bring to attention of employer to increase wage to the new minimum living wage if applicable.

Yeah my current salary is above the new minimum wage requirements but less than 40 but I am trying to find a 40k job in my same company or a new one

Not sure where you're reading that you will need to earn £40k or more to maintain your sponsored worker status.

In any case, you're worrying for something that is just a proposal and likely will have a minimum impact on workers already in the UK.

It will be changed to 35k or 38k announcement due at 5

Let's see if its affects workers already in the country

Keeping an eye on this. There may be a revision of going rates as well.

I think announcement is expected at 5 today.

SWV income threshold 38k
Income for Health and Care visa not affected now, New applicants can not bring dependants

It didnt clarify whether this would impact those already in the UK, I suppose it would. Not sure if there is a wider review of the going rates for all other occupations.

Usually these measurements are not retroactive and only affect new applications from the date this becomes official.

It's technically impossible to suddenly implement such salary increase to everyone with a SWV already in the UK. Also such situation would have a significant impact on the inflation, among other issues.

The new rules will come into play sometime in Spring 2024 - no exact date given as yet.
There will be a major rush from employers to gather up staff before the new threshold comes into being.
Those looking at spouse visas will no doubt want to push to get their applications submitted, the massive rise will prevent thousands of U.K. citizens from bringing a spouse to U.K. so this is a very anti marriage / partner policy.

I believe the huge hike in the earnings required for a spouse visa is unlikely to make it through to legislation. It is more likely to be stick with SW tho.

Outside of the health and care it would not be unrealistic to climb the minimum hourly rate substantially, if there was a desire to do so.
There is a major issue in certain sectors where migrant labour is used to undercut the nominal commercial going rate. The IT sector is one such sector where pricing is being impacted, so it could be entirely possible to do a year on year increase to bring the going rate up. This has been achieved in the care sector for cares so it is tried & tested.

Hi all,
At the moment I have a skilled worker visa for three years (until 2026). I am extremely upset about the new immigration rules and am looking for a solution to the problem now so as not to put myself in a difficult situation in the future. I currently have an average salary within my profession that meets the visa requirements, but I understand that my employer will not be able to pay me £38,000 when I need to extend my visa. I am considering the possibility of negotiating with my employer to reissue my CoS for five years. Then, technically, I will comply with all the rules before receiving the ILR. Or should I not rush into this yet?

My main worry is that I will be kicked out if I don't earn 38.7k salary by spring 2024

If you have valid visa until 2026, I don't think they can curtail your visa in between and ask you to go back if you do not make 38k. However, we are unsure about whether the new changes would be applied retrospectively (doubt it), and whether those in the UK would be affected by this, or are these changes targeting incoming workers only.
