Home Office Response to PAP - Reconsideration by March 14th - Good Sign or Just Standard Procedure?

Post by hussainahmed » Thu Dec 14, 2023 7:25 pm

I recently submitted a Pre-Action Protocol (PAP) letter challenging the Home Office's refusal of my visit visa application. Today, I received their response, and while it wasn't a full approval, it contained some promising information.

Here's the relevant part of the letter:

"The Secretary of State has reviewed the decision and will now proceed to reconsider the matter in the light of the evidence and representations you have made. The team aims to complete the reconsideration of this matter by the 14 March 2024, absent special circumstances."
My question is, does this mean my case is actually being re-evaluated, or is this just a standard procedure for responding to PAPs? I'm cautiously optimistic, but I don't want to get my hopes up too high.

Some additional details:
* My case involved concerns about the ECO's consideration of my sponsorship and income evidence.
* I provided additional documents with my PAP letter to address these concerns.
* The Home Office hasn't mentioned anything about their decision on the initial refusal yet.
I'd really appreciate any insights you can offer on what this response might signify and what my next steps should be.

Thanks in advance for your help!

The response is self explanatory and does not require expert dissection.
It also gave you a Tim's frame by which the hope to complete the reconsideration based on the PAP you raised.
Next step is to exercise patience and allo the process complete.

Visit Visa Refusal Overturned after PAP, Now Confused about Next Steps!

Post by hussainahmed » Thu Dec 21, 2023 4:03 pm

Hi everyone,

I'm writing with a mix of overwhelming relief and excitement, but also a touch of confusion, and hoping some experienced members of this amazing forum can shed some light!

After a pre-action protocol (PAP) review, I just received an email from the UKVI stating that the decision to refuse my visit visa application has been overturned!

However, the email goes on to say that I need to submit my passport to the Visa Application Centre (VAC) with a copy of the email. This is where my confusion starts. Here's the thing:
  • My local VFS requires a pre-appointment for all passport submissions.
  • I haven't received any official appointment confirmation or instructions beyond the email about the overturned decision.
So, my questions are:
  • Is this email generally a good sign and indicative of a successful visa grant? I'm cautiously optimistic, but some confirmation from others who've been through similar situations would be amazing!
  • How should I approach the VAC for passport submission without an appointment? Should I just explain the situation and hope they can accommodate me, or is there a specific procedure I need to follow?
Any advice or insights from anyone who's faced a similar situation or can point me in the right direction would be a godsend!

Thank you all in advance for your help and support!

we here can not tell you about how your local vfs operates exactly.
My approach would be to go there with the stated documents as UKVI outlined and without appointment. If thay does not work at least they will slthennstate how it should be done. OR if you are not in a hurry, make contact withntje VFS and ask

Any advice or insights from anyone who's faced a similar situation or can point me in the right direction would be a godsend!

Goodluck.

Hello! Actually PAP review varies case to case. You nees to download the PAP form from the following link-
https://assets.publishing.service.gov.u ... _v1.0.docx

It’s in word format. Fill the relevant boxs based on your situation and convert it into pdf. Then submit to the email stated on the bottom of the PAP form.

I hope this answers your query.

Reply back to the email and ask them how they want you to resubmit. Tell them how your local VAC works and if you'd need a reference number.

There's a direct line of communication open between you and them now, use it!

It's pretty straightforward. Download the form, fill the blank spaces, and address all issues that have been raised in the refusal letter. Point to where you think the ECO didn't attend to properly, especially if documents to that effect was submitted. You probably know your case better than any lawyer.

I'd say, take your time filling the application and present your situation strongly. I submitted mine without third party help. You don't require any specialised knowledge for this, to be honest. All the best.

NB: I got my visa last week!

  • Response to PAP received: December 14, 2023 (10 days)
  • UKVI email overturning decision & requesting passport: December 21, 2023 (7 days)

Thank you for sharing. Your timeline was very quick. well done! My friend did PAP (Didn't receive any response yet) and also wrote another email to complaints team mentioning the mistakes that case worker has made on the refusal letter. After the email to complaints teams, case worker had corrected the mistakes and resent a another refusal letter with a changing in some wordings. So my friend is super confused now if she need to do another PAP on the new refusal letter or just wait for the response on the first PAP itself so she can then also use this corrected refusal letter as a defense to show how they are made and corrected mistakes. I could share her both refusal letters here if anyone could be kind enough to give to their valuable advice :)
