Hello friends.
It seems I need your help. At the moment I am in the process of changing employer (I am already in the UK on a Skilled worker visa).
My new employer gave me a CoS and paid for everything, including priority service. I successfully submitted my application, but on the third day I received an email "Thank you for your application for permission to stay in the UK.
Although we would normally decide your application within 5 days from the date it was submitted, unfortunately this is not going to be possible in your case.
The UK Decision Making Centre is currently assessing the application, but we are unable to conclude the application currently as we require additional information/action from your sponsor.
Please note, as we have requested additional information for us to conclude your application, it may not be possible to make a decision within service standard in this instance.".
The problem was that the employer quoted £20 less in annual salary than required .
In the email that HO sent to my employer, there was a recommendation to make a note in the certificate about an increase in salary or a decrease in working hours. The employer called the HO, where they confirmed that this error was not critical and did not require a CoS reissue; it would be enough to make a note. On the same day, the employer did everything according to the instructions and additionally responded to an email from HO, in which he described the problem in detail and apologized. He received an automatic response stating that additional information would be added to my application.
More than a month has passed since then and no further information has been received. I understand that the money that was paid for priority service was lost because the problem was on the employer's side, but I am concerned about two things:
1. In such a situation, usually the application process follows the standard 8 week process, or can a decision be made faster?
2. In CoS, the work start date is 14 January 2024. What happens if no decision on the visa is made by then?
And in general, how much does the probability of failure increase in such a situation?
Many thanks for your help!
