Employee of overseas representative visa

Post by Usamamalik533 » Sat Dec 23, 2023 10:07 pm

Dear Sirs,

Can anyone help me in my query as i am not sure where to post this query.

I am here employee of overseas representative visa, my employer wants to open company and we had meeting with one accountant and he suggested as my employer is overseas it will be difficult to open bank account for the company.

He suggested i can be director of company and my employer can be sharehollder and this might will help me to open business account?

So does any one know any solution what should i be doing as i do not want to be director or shareholder.

As my employer will spend his own money to set up business here in uk.

Thanks

Setting up the company as suggested is not a good idea as technically it would invalidate your visa. You are not allowed to work for another company nor are you allowed to set up your own business.

However see the guidance - you could do so under a different visa type

Basically the main reason is that my friend came Uk

Anyone here another solution for how to survive on this visa

It looks like a pretty desperate situation. An extension to the visa is very unlikely if not impossible based on the circumstances outlined.
If the UK business is not even set up and there is no evidence to demonstrate business activity then in essence nothing has happened since the initial grant of the visa.
The Home Office is not going to grant an additional 2 years based on the lack of progress made to date.
Alternative routes to remain - probably find an employer and get a skilled worker visa.

The tax issue - with no legal entity for PAYE to be registered - he will need to make a self declaration to account for the salary received.
That in itself will be problematic as it will appear he is self employed - which will add to the issues.

It's quite simple: transfer 100% of your shares into your name temporarily, open a bank account, then after a few days when the account is open, transfer the shares back to the parent company's name. You could even inform the home office that this was done for the purpose of opening a bank account and that you had permission from the parent company to do so.
