Liquidation after ILR

Post by idainhaus » Mon Jan 22, 2024 4:36 pm

Hello Everyone,

I am about to apply for myself and my wife by the first week of the FEB.

TIE to ILR and now hopefully 1year after ILR.

My question is that we got our ILR on 01/02/2023,
and our previous business,
(Not the one we rely on for the ILR )
(we rely on the Extension which was running at the time. 2020)
went into Liquidation, as it was a Cafe and hit by COVID restrictions.Commencement of winding up on 17/02/2023 right after ILR.
Myself and my wife are directors of the company. How can I explain the matter to the Home office? Do I need to provide all the documents that which liquidators provided to us ? or just explain them in the cover letter?

Moreover, I did get several Parking tickets, congestion charges, and bus lanes, but all paid at the time, Never had any Points or speeding tickets. I cannot remember all of them for the past 5 years, how I mention all of them ? or some fair enough? maybe 2 to 3 tickets a year.

Thank you

I trust you mean that you will be applying to Naturalisation right? If so, a business is an entity in it self, if it went into liquidation this doesn't affect your personal records even if you are a director in my views.

It does. The casework guidance says clearly company went into liquidation indicates financial issue of the application.

Not necessarily a reason for refusal.

Page 38:

"However, where the person was made bankrupt or their company went into
liquidation through little or no fault of their own, the application will not normally be
refused. For example, they may have simply been a victim of the poor business
decisions of others or their business has been severely affected by an economic
downturn."

You probably need to provide explanation in the cover letter. It is good you paid all your tickets, but getting many of them especially in a short amount of time leading up to the application can point to a pattern of disregarding the law. Did you get any Fixed Penalty Notices?

Hello ,

appreciate if someone could help me with the below question, AN application,

May I know do I have to Select an option that says about:

A civil court judgment against you, for example, nonpayment of debt, or bankruptcy processing?

because there is no word of LIQUIDATION,

I will explain in the cover letter for sure, but what about this question?

thank you

If none of those happened in the liquidation process, then select NO.
