EUTR3 Employment and Rental query

Hello Immigrationboards!

I need to apply for an EUTR3 for my wife who's 5 year visa is going to expire this year.

Everything makes sense on what to supply, aside from Employment and Rental documents.

I just finished with a solicitor from Gibson Associates and they said we need to submit only the current Rental Agreement and current Work Employment in the form of a letter or contract.

Furthermore, they mentioned to submit Tax Credit Certificates for each year. No mention of Employment Detail Summaries.

Although after reading online it says to submit:

* Employment Detail summaries for each year
* Two Payslips for each year
* Work contract for term of employment
* Rental contract for each year

Which is correct? So far I have this.

* 6 months bank statements each year (me and spouse)
* 6 months joint bank statements each year
* last 3 months payslips (me and spouse)
* copy of passport and all blank pages (me and spouse)
* 2 passport photos (me and spouse)
* copies of IRP card
* copy of birth certificates (me and spouse)
* letter from current work (me and spouse)
* current rental agreement
* tax credit certificates each year (me and spouse)
* utility bill from each year (me and spouse)

Sorry this is a bit long winded, just nervous as this is a big step.

If anyone can assist I'd be super thankful.

Hi

I would advise you to follow the required document listed on the EUTR3 form and explanatory leaflet. Most people do not use solicitors and have successful applications following those instructions. If the immigration department requires further information they will request it. According to the EUTR3 form (section 5) and explanatory leaflet (page 3 & 4) :

P60 or Employment Detail Summaries for the last 5 years - Yes (1 document per year as these are issued annually = 5 documents)
2 payslips from current employer (for EU citizen only) - Yes
Work contracts for each employment or employment letter for last 5 years (for EU citizen only) - Yes
Rental agreement or letter from landlord/agency or RTB per address in the last 5 years - Yes
Utility bills in names of both spouses in the last 5 years - Yes

Bank statements, non-EU citizen’s payslips, tax credit certificates and birth certificates are not required for the EUTR3 form and explanatory leaflet. You can send them if you choose to but they are not listed as required documents.

I understand you want a correct application and successful outcome. I would advise to review the required documents per the form and explanatory leaflet, provide what they ask for and you should be fine. You can ask additional questions here or see previous questions asked by other applicants.

That's a shame about the solicitor's being totally off and wrong in their suggestions!

I can't see in Explanatory leaflet where they asking

(Work contracts for each employment or employment letter for last 5 years (for EU citizen only) - Yes)
I guess they are asking current work letter or contract along with employment details summary for last 5 years ?

It starts with: (A) For each period of employment ….

Just an update on this - I got this sent off 9th February via registered post and by a solicitor.

Will update this further when I receive correspondence from immigration - hopefully not too long! making me nervous as always.

We got our approval letter on the 8th of March saying that our application was successful

I went with [REDACTED] - they weren't too bad, but I wouldn't go with them again due to a mistake they made in submission. All ended up fine either way.

Are you asking for a list of what I submitted to my solicitor? If so, let me know and I can advise

I have actually returned earlier as I am confused about one thing - not sure if anyone can advise!

So, I'm a British Citizen, and my Wife came here in 2018 - prior to Brexit being triggered.

She has an Article 50 TEU card.

Under 1.18 Permission type for renewal

I assume we pick "Withdrawal Agreement Beneficiary"?

We paid €2,000 - honestly I don't think it's worth it considering they even made a mistake with my application.

I sent off the following:

I don't understand one thing about Employment Detail Summary how it could be possible two name on Employment Detail Summary your and applicant name on it ???
I guess Employment Detail Summary should be on your name not your spouse name .
And why you both send off your birth certificates. I can't see such a requirement on EUTR3 Explanatory leaflet

Spot on, that's correct - it should be on your name as you are the sponsor of the application.

You do not have to send the birth certificates, we just hand them to hand and was advised to do as such - it is not on the documentation requirement submission checklist, so you'll be fine.

Just curious as to how long it took for your application yo be processed. I sent mine in February and needed more documentation on March, which I sent straight away but I still haven't recieved any confirmation... anything really.

I have constantly emailed them but no response either.

Hoping you shed some light.
