ILR Application date and Dependant Extension Questions

Post by Swarty » Sun Feb 19, 2023 7:07 pm

Hi,

I hope you are well.

I need a little advice regarding my ILR application for next year.

1. What is the earliest date I can apply?
Passport Visa Date Issued Valid from: 18/03/2019
UK Entry Date Passport Stamp: 22/03/2019
BRP VIsa Expiry Date: 14/04/24

2. My dependents arrived 19/12/2019, 9 months after my arrival.
I understand that they cant apply for ILR at the same time and need to apply for a dependent extension.
My question is the following:
a. Is the visa for a full 3 years even though I only need 9 months before we apply for their ILR.
b. Will I have to pay for 3 years IHS?
c. Will I be able to get a refund for 2 years if I paid for 3 years IHS and applied for ILR after the 9 months.

Thanks

What visa category do you hold?? Useful to state this as different visa have different rules.

This query has been answered hundreds of times before. No shorter visa is issued, and no refund is given for IHS after the extension is granted. An extension period is fixed. Applying for ILR will not change anything and you will not get any refund

Thanks Zimba,

Regarding Question 1.

Am I right in thinking I can apply for my ILR 18/02/2024?

Thanks

ILR Applicatiopn before the 28 day timeline

Post by Swarty » Thu Dec 28, 2023 7:35 pm

God Day,

I trust this email finds you well.

I am writing to inquire about the process for submitting my Indefinite Leave to Remain (ILR) application. My 5-year and 28-day qualifying period will be completed on February 18, 2024.

I would like to begin preparing my application in advance but wanted to confirm whether I can initiate the process before the specified date and delay the actual submission until February 18, 2024. Could you please clarify if this is possible, or if the application can only be started and submitted on the 18th of February?

Your guidance on this matter would be greatly appreciated.

Thank you for your time and assistance.

You can proceed with your application up until you submit and pay online in advance.

You can also submit it way before the date and delay the biometrics.

You would become eligible for ILR within 28 days of completing your 5 years.

Hi Thanks for all the info so far.

I have a few more questions: Skilled Worker 5 Years

BRP Issue Date: 04 March 2019
Passport Visa Date Issued Valid from: 18/03/2019

1. Do the Home office use the BRP Issue date or only the Passport date for the 28 days qualifying period?

2. I have now completed my ILR application online and I m ready to pay. Can I Submit and pay today 13/02/2024 and delay my Biometrics for next week within the 28 days?

Whichever date is earlier, so in your case 4th March.
2. I have now completed my ILR application online and I m ready to pay. Can I Submit and pay today 13/02/2024 and delay my Biometrics for next week within the 28 days?
Yes!

Thanks that is great news which means I am in my 28 days now.

Just one more question:

Date you first entered the UK? - Do I enter the BRP issue date or the actual stamp on my passport?

Thanks
