Well, if you have declared it then it is a mistake.
What is your criminal record? Full 10 months sentence or is this what you’ve spent in prison?

I spent 5 months in prison, 11 years ago. My sentence was 10 months in total. It has to be a mistake from the case worker, because I have a copy of the application I submitted and I declared it and also included my dbs report, but I did not include any cover letter or present mitigating circumstances, which is not the reason that was stated. I am going to seek a review of the decision

Similar case to mine , seems like having Imprisonment sentences Is difficult to have citizenship really. HO will somehow come with a reason .no matter how many years have passed It will still follow you up. Mine is enter the country illegally working illegally using false passport. I never been forgiven for this.

Has anyone who got refused put in for reconsideration yet?

Has anyone got any idea how long the reconsideration process takes on average?

Saw a couple of articles where some people mentioned waiting over a year for a response.

There may not be that many applicants on the forum who have been refused and submitted reconsideration.
Has anyone got any idea how long the reconsideration process takes on average?
There's no stated service level for reconsideration applications.
Saw a couple of articles where some people mentioned waiting over a year for a response.

Mine asked for £200 plus VAT, maybe its because they handled the initial application as well.

Hey all

I just got a response for my reconsideration application, and they acknowledged that it was an error on the part of the decision maker, that I actually declared my conviction, and hence they have updated that on their system, BUT due to the fact that I did not include any substantial evidence of mitigating factors to prove that I am now of good character they feel I have not met the requirement. My solicitor is suggesting we go for JR, but I am not convinced this is the best course of action. Any advice or suggestion guys?

Hi,

JR maybe your only option now if your reconsideration was refused.

The only drawback with JR is that it is quiet expensive. Solicitors tend to advise against going down that route. However, if your solicitor is proposing it, then my advise is to take it up, provided you have the means to fund it.

There is a reason that solicitors don't advise going down the JR route.

Firstly, I am not sure that JR is an option for naturalisation. Remember that naturalisation is not a part of the immigration pathway, which ends at ILR. It is a separate process, with different laws and requirements.

Secondly, courts tend to not want to made into decisions on citizenship. They would not have the resources to check if the person meets the naturalisation criteria.

Thirdly, remember that naturalisation is never by right/entitlement, but always discretionary.

So, unless your solicitor can show how the Home Office made a legal error in their assessment of you, I think a JR would be an expensive mistake.

I would advise applying again with evidence your character has changed (eg through volunteering or otherwise serving your community).
