Seen too many posts lately about members reporting VFS not accepting passport renewal for minor child if even one parent has renounced their citizenship.

Please note that VFS is just an outsourced service provider. They do overstep their authority and some officials try to act smart, thinking (wrongly) they have some power.

Just yesterday, after a long battle, the Delhi high court has noted that the Citizenship Act of 1955 supersedes provisions outlined in the Passport Manual of 2020. The HC underlined that a subordinate legislation cannot override primary legislation. Children do not lose the right to their passport because a parent has renounced his/her. Similar rulings have been decreed by other High Courts in Kerala etc.

It will take some time for it to trickle down, but hopefully this puts everyone at ease.

It is important to remember that sometimes organizations such as VFS may act outside their mandate. The Delhi High Court decision confirms that children are not deprived of the right to a passport because one of the parents renounces citizenship. This is an important step towards protecting children's rights and their access to documents. Court decisions like this help establish legal norms and principles, and while these changes may take some time to spread, they bring relief and hope to people.

Hi,

Unfortunately the Indian Embassy is still not responding positively to emails and texts or giving a go ahead for accepting Minor Indian child's Passport renewals.

I would like to know if anyone body has managed to renew their child's passport since Oct 2023
