Absence in spouse visa

Post by bd1982 » Sat Apr 06, 2024 10:14 pm

Dear all, need a suggestion. My wife is on spouse visa now and will apply for Settlement in end of 2025. Due to a family reason we both are currently staying in home country for more than 180 days. So will it be any issue when applying for SET-M in future?

Nope, no limitations to how much time spouse of Brits or settled person can spend outside the UK, when applying for settlement.
No sin in failing, you just have to try and try again!

Thank you for your reply. My concern is if in future UKVI bring any absence restriction will it be applicable for my wife's case?

Until a change is announced or proposed no one can answer that question.

IF and that is a massive guess type IF there is a change it is likely to be that ILR will not be considered until a period of 5 years actual residency is achieved. So periods outside the UK could be discounted - therefore you have to extend the visa until a full 5x365 days residency is achieved.
