Naturalisation as the Spouse of a British citizen/Divorce Proceedings

Post by seekingadvice87 » Sat Apr 06, 2024 3:44 pm

Hi there,

Can the spouse of a British citizen who are separated apply for the naturalisation process immediately after obtaining ILR or do they need to wait for a few months until after the divorce proceedings.

How will they fill out the form. Married to a British citizen or not.

Do they show 3 years residence or 5?

Thank you.

Until the divorce is finalised you can apply as spouse of a British citizen, apply straight after ILR and show 3 year evidence of residence. You will need marriage certificate and all pages of ex spouse's passport though, so either you have that or you will need your ex spouse to provide it.

Hi,

Does he only need his ex's passport pages or the actual passport bio page? What about where the spouse needs to sign the application form for being the spouse and to consent to her ID being used for his application? I don't think his wife will allow her ID to be used.

Thank you.

All pages, including the bio page, are needed. I don't believe consent from ex spouse is needed but other members can advise further on that.

If he can't get these details will need to wait a year after ILR and provide 5 years evidence.

Only the British spouse Biometric page is needed. Unsure why you keep advising the full passport of the British spouse is required, it is not.

Hi all,

Thank you for all your response.

Does he need to provide his wife's original passport page or a photocopy of both his wife's passport bio page and copy or original marriage certificate?

Thank you but he will not be able to request these documents from his spouse. Guess he'd need to wait a year. Thanks for your advice
