ILR long residence

Post by Mya101 » Fri Dec 22, 2023 5:30 pm

Please I need assistant about my case,I don’t know if this is the right place but I will really appreciate any help

I’m about to apply for my ILR in January base on 10 year long residency but I have been out of UK for 6months with proof in that over 10 years but I’m not sure if I should go on and apply because my 10 year complete on January or I should wait till first week of MAY because I still have leave to remain till May.

Thanks

This is too vague for a conclusive answer.
When were you in the UK and if you had long absences, how long were they?

The limit is NOT 6 months in total over the 10 years. The limit is actually 540 days in total over 10 years.
Also if you have had a continuous period of absence over 6 months, then your continuous residence is broken under the long residence route. Under the family route there is no absence limit, so you can apply using form SET(M) after having had 120 months of leave under the family route

Thank you so much for your prompt response that absence is clear to me. Please I want to know more the 120 months of leave.can I count my completing 120 months of leave to remain if I was granted 10 years route in January 2014 base on partner and the second one on partner but the third one is base on parent and I’m just going to complete my third 2.5 leave in January 2024 or I will have to renew for the 4th times before I can apply for indefinite leave.

If this happened in 2014, then you should not face any issues

Thank you Zimba,I’m so relief now but I also want to know if police drop drinking driving offences case because of no evidence can that have any issue on my indefinite leave.

The case happened in 2020 and Police drop the case in 2021 and I was granted 2.5 leave to remain in 2021.

Thank you

The correct form for people under 10 year family route is the adult settlement form: https://visas-immigration.service.gov.u ... t-relative

Thanks for your response ZimbaEvidence of Me having access to my children such as a written agreement between both parents or a child arrangement order.the problem is we both don’t have any written agreement and no child arrangement order aswel but she refused to write letter confirming my roles in our children as we are no more together.

And they also requesting Document(s) showing your child / children's immigration status such as passports, biometric residence cards, or vignettes but my children are born by a British Mother and they don’t have British passports yet because they have not left uk for once.

I’m applying for my indefinite leave to remain.please I will need your assistant because I have need to upload all the documents before my biometric enrolment.Thank you

You should write a cover letter explaining your situation, providing proof that you are paying child support and saying that she refused to write a written agreement. Also mentioning that children are British already will be enough
