As per HSMPFORUM

"We have filed the Judicial Review Application on 8th October 2008 challenging the April 2006 4 to 5 years Indefinite Leave to Remain Changes. The challenge has been raised on the basis of our 8th April 2008 Judicial Review Judgment and the subsequent policy document implemented by Home Office on the 9th July 2008 which did not consider the ILR issue"

Hopefully they will win the case as they Judge has already given the decision in their favour

"Justice Sir George Newman, in our 8th April 2008 Judicial Review judgement observed “I find that the terms of the scheme, properly interpreted in context and read with the guidance and the rules, contain a clear representation, made by the defendant, that once a migrant had embarked on the scheme he would enjoy the benefits of the scheme according to the terms prevailing at the date he joined.â€

My wife also received her work permit in September 2004 and I also donated money for VBSI. I am ready to donate money again. But what exactly we have to do now?

The best thing is will be if we can trace out who filed the case on behalf of VBSI before . we can contact them and ask them our legal standing now and if those solictors are willing to case again.
Another thing could be to contact HSMPFORUM and ask them to add us in as 4-5 change affected ALL employment routes so work permit holders were effected .
I am still searching any clues about wherabouts of VBSI ? any contact ? any person behing it ... please reply ..
currently we are only 4 people ..Mansawant's wife , snow , myself and smiles 345 . we obviously need more people ... please contact the WP Holders you know..

contacting the HSMP forum will be great idea. can we send an email to them ? i'm sure there will be lot of people [WP holders]interested to join us. is there any phone number for HSMP people we can contact? we are all ready to donate money towards it

I have spoken to people at HSMP FORUM . They have lodged the application now so obviously they cannot add us in. But if we wait for this decision and if the decision is in their favor ( fingers crossed !!! ) Then we will be in a better position to lodge a new fresh case.

Home Office is NOW refusing 4 year ILR even after HO lost the case.HO insists that HSMPFORUM winning the case has nothing to do with 4-5 year changes as these changed were not just for HSMP.

So i think if we wait and watch and in the mean time make a list of people who are willing to contribute. Whenever court rules on HSMP 4-5 Years , if its not applicable to WP holders , then we lodge the case.

rashidsha, thank you for your reply. when do you think the outcome from the court? i know around 9 WP holders who are ready to contribute. as soon as the verdict comes we will arrange meeting in London where we can get as many people as we could.

They ask for a contribution to join the forum. It's minimum £50 that will go to the HSMP Judicial Review for ILR expenses. But you don't have to pay this to contact them and ask them a question. However, if you are going to ask for information on a regular basis, it is best to join the forum.

For WP holders, it is best to just see the outcome of the HSMP case first. Then revive the VBSI case if HSMP wins.

if you read the JR ruling it is very clear there. you can check the UK BIAwebsite as well and there's a document.
