PBSAppendix1 - Indian Application - Help Needed

Post by SAPIENT » Fri Jan 02, 2009 4:53 am

Dear Friends,

This is regarding the pbsappendix1 application, which is needed for PBS=Tier1 General Migrant.

I have a query in Section for Previous Earning ( Question # 4.7).
I have worked with 2 employers in last 12 months.
There has been a gap of 2 working weeks for changing company.

Should the claiming period include the 2 working week gap?.

Thanks in Advance,
sapient

Sapient,
Guidance says:

86. An applicant does not have to be in continuous or full-time employment during the 12 months being assessed.
My case is also similar. I had one week delay in joining the second employer, but I have given the break up of the salary clearly for two employers showing the gap in the earnings cover letter. Based on the above guidance which says applicant need not be employed all the time during the claim period. Hence I am going to put the claim date continuously(in my case Jan 2008-December 2008).

Please let me know your views on this.

Thanks

Yes. the 12 month period must be continuous without any break whether or not you have earned any amount during some weeks/months within the 12 month period.

Hi,

When change of employer happens, there might be some weeks/months gap (without pay) right!
For example, if there is a gap of one month, then can we provide 13 months period in which one month gap exist and 12 month earning period exist.

And there is a guidance note:

What does it mean then?

No. 12 months mean 12 months. What the guidance note means is you can not be working during some of the weeks/months or working part time during the said 12 month period and HO is not fussed about it.

The question # 4.7 goes as follows
"Please specify start and end dates of the period for which you are claiming previous earnings".

There are 4 line items with Start Date and End Date.
So, the Start and End Date will be split for these 2 cases:

1) People who have taken full time study within last 12 months
2) People who have taken maternity and adoption related leaves within 12 months.

is this correct?.

thanks in advance

Yes and in a case like yours one would be using just one row to indicate the 12 month period. Does that answer your query or there is something else thats bothering you? Happy to help if you could elaborate please, in that case.
