Home Office objection - Minimum salary ambiguity

Switching from a Graduate visa to skilled worker visa as a New Entrant

COS assigned: 19 March 2024
COS Start Date: 1st April
Total weekly hours of work: 39.0
Salary: £22000.00
Job title: Graphic designer
Job type: 3421 Graphic designers

Visa Application: 23rd March
ISC not paid email: 28 March
ISC paid: 29 March

29 April: Email received from home office:
The current salary is under the minimum pro-rated requirement, please amend the salary and or working hours on the sponsor notes of the assigned CoS to meet the guidelines within working 10 days.

There is some ambiguity regarding the minimum pay. A new entrant who had submitted an application before April 4th must have a minimum salary above £22000?

£22000 salary in under minimum UK salary , Minimum Hourly wage currently is £11.44 . You showed 39 hours (11.44*39)* 52 = £23,200.32.

Please amend it to at least £23,201 . Or reduced hours to 37.5 , in this case you have to show minimum salary of £22.309.
Consider yourself lucky HO has asked your employer to amend it .

So there is no minimum number of hours required by home office for sponsorship?

The annual salaries for these jobs are based on a 37.5-hour working week. They must be pro-rated for other working patterns, based on the weekly working hours stated by your employer.

Its best to use 37.5 or above weekly hours for easy calculation.
