Query on ILR route on 5 years Tier 2/ skilled worker visa

Post by Rangu2006 » Wed Jan 31, 2024 11:27 pm

I am looking some advice for my son ILR application. I am in ILR and my wife and kids will complete 5 years in the UK on 18-JUN-2024 on Skilled worker/ Tier 2 general dependent visa.

In 23-MAY-2024 my son 18th birthday.
Do he needs to write Life in the UK test?

My second kid 13years. she will be under child category, but my first kid have confusion.

Do i need to submit my wife separate application and my kids separate application or all three in one application?

can i submit online application for my son a month before ?

Kind Regards
Ranganathan

Children do NOT have a residence requirement, they settle when parents both settle.
Children below 18 can be included in your spouse's SET(O) application.
Children who become 18 need to file a separate SET(O) application and meet the LIUK and English language requirement

Thank you so much Zimba!

Once again, can I apply 28 days before 5 years completion for the ILR?
My son will turn 18 after the 28 days allowance (1 day later). He studied GCSE and currently in A Level. Does he still need to write the LIUK test?

Kind Regards
Ranganathan

28-day concession applies to all adult ILR applicants. You may include both children in your application as at the time of application they are all below 18, so UKVI may not require LIUK and English language tests when the child becomes 18

The date of submission is not that important. In order to get ILR you need to ensure that the date of ILR decision is within 28 days of completing the 5 years. I explained this here: How to apply early and benefit from the date of the ILR decision ?

Yes, she needs to show English proficiency. For children just provide passports

One more doubt. I got ILR 02-Oct-2023. When I will be eligible to apply UK Passport or I should apply evisa due to BRP expire on 31-DEC-2024 ?

Apply for naturalisation after 2 October 2024.
Once British apply for a passport.
Post questions on naturalisation in the British Citizenship forum: british-citizenship/

ILR does not have an expiry. A British passport is a travel document that only British citizens can get. As advised, you must apply to naturalise as a British citizen first and attend your ceremony before being able to apply for a British passport

Hi

Regarding the ILR dependant visa, I came across that we are supposed to write the IELTS test for English Language requirement...

What is the minimum score required for a successful application?

Are there any websites that you would recommend for understanding and preparing for the IELTS test?

I came to know that the IELTS has four parts (reading, writing, listening, and speaking).
Does the ILR dependent applicant need to do all four categories?

It would be great if you could confirm which specific IELTS test is required by the ILR dependent applicant...

Kind Regards
Ranganathan

The regular IELTS is not needed.
Instead, B1 SELT is the standard quick test to satisfy the requirements of ILR.
A great place to look at is Trinity College London website: https://www.trinitycollege.com/qualific ... SE-grade-5

Thank you Zimba!

can we use UK Enic statement of comparability for English proficiency?
1.Comparable UK Qualifications : Master's degree
2.Comparable UK Qualifications : Bachelor degree

No, the 'Statement of Comparability' from UK ENIC is NOT suitable to prove English language level.
You need an appropriate 'Visas and Nationality Statement' document from ECCTIS: https://ecctis.com/Qualifications/VAN/Default.aspx
As I told you above, SELT is the easiest and fastest route

Hi

Is it possible to pay the UKVI ILR application fees with two payment cards?

Or are there any other payment methods that doesn't involve one payment card?

Kind Regards
Ranganathan
