Minor stateless after OCI

Hi,

I have recently received UK citizenship and as part of OCI have to renounce my Indian Citizenship. However my dependents are all in India and hold Indian Citizenship. My minor kid(elder) has a passport which will expire soon and my younger kid doesn't not have a passport. Both are ofcourse born in India. When I apply for renunciation, what will be the state of my minor kids?? I planned to go back to India hence applying for OCI. The section 8 of citizenship act seems to be unfair as per UN convention on statelessness for minor kids.

Hi Rajesh,

I have contacted the Embassy in UK and haven't rec'd any clear answer from them. They just keep saying contact the ministry of home affairs.

My suggestion would be to contact your nearest Embassy yourself and try hiring a lawyer specialised in these issues, may even need to file a case in court. We are trying to do the same.

This situation is very unfair to many families. Am quite surprised people have not started an online Petition for changing these unfair rules.

I have written to Birmingham embassy and their response is "The matter of citizenship of minors has been taken up with the Ministry and decision on the same will be reflected in the guidelines for renunciation of Indian citizenship."

If you have not yet renounced your citizenship and only surrendered you passport, go thru the below link

It seems someone has managed to get passports for their kids via VFS Birmingham. Not sure how this helps you. But could be a similar situation.

Mine is a bit weird place at the moment. I wish to go back to India. And my family will not be coming back. I'm going for OCI so that i can work in India and without renunciation, i wont get OCI.

Hi Rajesh,

Did you try contacting your local PSK in India?

Because nowhere in the Indian Passport Portal - this Section8(2) is mentioned. They might not yet be aware of the rules and your children might get a Indian Passport if you apply quickly enough. ( I am thinking of this option, but don't want to get stuck there if renewal is not successful)

And if they already have an Aadhar card / name in ration cards, how can the govt prove they are not citizens?

I am still researching various options as my kids are not eligible for British citizenship and if they are not eligible for Indian citizens too .. don't know hat is their current status.

Pls do share any updates you find.

We are thinking of travelling to India for the kids' passport renewal and would like to know if somebody already had some success.

No updates from the Embassy her in UK about this issue, so am trying to find any option available.

Have you tried mailing CGI Birmingham. I got a same day reply from them but they asked me to contact HCI London. HCI havent replied to my mail since a week

Have you tried mailing CGI Birmingham. I got a same day reply from them but they asked me to contact HCI London. HCI havent replied to my mail since a week

I have contacted all 3 CGIs (since 5 April 2024). London has not replied even after 3-4 mails, seems like their mail is not being monitored. CGI Birmingham asked me to contact Edinburgh (that's my jurisdiction). Edinburgh CGI mentioned they are awaiting instructions from Ministry.

I am trying to get a in person appointment to state our situation, but they are not allowing that also.

I tried to submit my kids application in VFS Edinburgh on 05/04/2024 the first time, it was not accepted.
The second time, I tried on 29/04/2024 again at VFS Edinburgh. It was not accepted this time too.

The staff at VFS keep on showing the pop-up message on the Indian passport Renunciation website and refuse to take the application.

What is this HC judgement that you have mentioned? Can you share the link please?

Ah understood Char! Unfortunately due to lethargic attitude of the Indian High Commission , a lot of people are stuck in limbo with their children not having any passport.

There isnt much we can do about this online, so I was trying to get a group organized with people who are in the same boat so we can approach HCI and get some clarity .

Pls do keep us updated if you hear from anything from the passport office in India. A few months back I tried emailing a couple of officers in the Indian Passport office. I did not receive any reply ( This was when I thought to travel to India and renew my kids passport there)

Also, please let us know if they are accepting and processing the applications. Since your kids are already in India, you would be our guide in this process.

I have submitted a grievance through the designated portal, addressing the Indian Prime Minister and reporting an issue with the Indian Consulate in the UK.

I can now see that the complaint has been processed and forwarded to the High Commission of India in London. I would those affected to raise similar grievances so that a solution can be found soon. It is best to submit these complaints under the 'Indian External Affairs' category to ensure they reach the appropriate department. I have detailed the entire issue, including the recent Delhi High Court verdict and the different Indian passport renewal procedures followed by Indian consulates in Australia, New Zealand, and other countries. The Indian Consulate in London is not prioritizing children's futures and is refusing to process minor Indian passport applications. Once you have submitted your grievance, keep checking the status using the complaint reference number to see if it has reached the Indian Consulate in London.
