Free Entitlement - Public Funds

Can Seniors, experts or Moderators like JOHN reply for my query please..

As mentioned in my earlier post about Public Funds - Child Benefit

I am an Indian National, living in UK since Oct 07 on Work Permit where it specailly mentioned - No Recourse to Public Funds..

But i tried to contact the Childrent Information Service in W. Sussex and told about my case and WP notes and asked is my child eligable to avail the Free Entitlement they offered...

The Gentleman who than spoke to their Specilist in this topic but the Lady (who i think is specialist in deaing these things) was not sure but told me that my child can use the Free Entitlement, all the children in UK can use this facility.. (but as i can not take this as proof and apply because, when i mentioned about my WP--> Tier1 application, and questions about Public Funds need to be answered in the application) she went calm.. As little information is dangerous...

Even in student visa it is mentioned - no recourse to public funds but you are exempted from council tax and child access to schooling.

They state: "All students, including international students, do not have to pay Council Tax and neither do most international student dependents. Any child (5-18 yrs old) resident in the UK can attend a state funded school free of charge. The council tax exemption and access to schooling do not breach the 'no recourse to public funds' criteria."

Hope this gives some direction.

Thanks Bluespeed for enlightening with the info you provided with, that you have...

I agree with you but in my case i child is 3yrs old (not falling in the 5-18category also)... will dig more on this info..

Even, my child is 3 years old and we would be enrolling her under early years this term. I think the school website didn't probably know much well that early years is available right from 3 years and not 5 years.

It needs to be appreciated that the definition of Public Funds, as in para 6 of the Immigration Rules, makes no attempt to classify every possible type of benefit within that definition.

The good news is that there is nothing health-related, nor anything education-related, in the definition of Public Funds, so no problem anyone claiming Early Years Provision.

If anyone doubts this, just click here and read the definition of Public Funds for yourself.

As mentioned earlier i sent email to Children's info service and got the below reply.. This is more clear and staright forward...

Your child is eligible for the Free Entitlement, even though you have 'NO Recourse to Public Funds' on your permit (or other documents).

The Surestart Code of Practice on the Provision of Free Nursery Education Places for Three & Four Year olds (February 2006) is attached if needed. Please refer to point 7.3 on page 21 which states "A child moving to England from another country is entitled to free nursery education on the same basis as any other child regardless of whether they have British citizenship"

You may show this to your nursery/preschool should they query whether your child is eligible.

As i am applying for WP--> Tier1(G),
QUESTION: Is it right is saying NO to question in Dependent Application of my child

SECTION 4 - K1. Is the dependant receiving any public funds?

For this I tick mark NO, but mention it in cover letter that my child utlizes Free Entitlement and attach the email from the Children Information service - West Sussex?
